6 This act modifies the Utah Procurement Code. The act allows for an exemption from
7 Procurement Code when a public procurement unit purchases tangible assets used in the
8 Olympics.
9 This act affects sections of Utah Code Annotated 1953 as follows:

12 ENACTS:
13 63-56-35.9, Utah Code Annotated 1953
14 Be it enacted by the Legislature of the state of Utah:
15 Section 1. Section 63-55b-163 is amended to read:
16 63-55b-163. Repeal dates -- Title 63.
17 (1) Title 63, Chapter 95, Parts 2 and 3 are repealed July 1, 2004.
18 (2) Sections 63-63b-101 and 63-63b-102 are repealed on July 1, 2002.
19 (3) Section 63-56-35.9 is repealed July 1, 2005.
20 Section 2. Section 63-56-35.9 is enacted to read:
21 63-56-35.9. Purchase of tangible assets donated for use during Olympics.
22 (1) As used in this section:
23 (a) "Command" means the State Olympic Public Safety Command created in Section
24 53-12-201 .
25 (b) "Exempt procurement unit" means any political subdivision exempt from the
26 requirements of this chapter.
27 (c) "Olympics" has the same meaning as in Section 63A-10-102 .
28 (d) "Organizing committee" has the same meaning as in Section 63A-10-102 .
29 (2) Notwithstanding any other provision of this chapter, a public procurement unit may,
30 without competitive bidding or a competitive proposal, enter into a contract with a private entity,
31 the organizing committee, or the command to purchase a tangible asset that a private entity leased,
32 sold, or donated to the organizing committee or the command for use in connection with the
33 Olympics if the procurement unit conducts an independent cost analysis and makes a written
34 finding that the price offered for the tangible asset considered for purchase does not exceed the fair
35 market value of the asset.
36 (3) An exempt procurement unit may adopt a resolution or ordinance, substantially similar
37 to Subsection (2), that allows the exempt procurement unit to enter into a contract with a private
38 entity, the organizing committee, or the command to purchase a tangible asset as provided in
39 Subsection (2).
