             6      This joint resolution modifies the Legislature's Code of Official Conduct to allow legislators
             7      to contract with the state using any method authorized by the Utah Procurement Code. This
             8      resolution takes effect upon approval by both the House and Senate.
             9      This resolution affects legislative rules as follows:
             10      AMENDS:
             11          JR-16.03
             12      Be it resolved by the Legislature of the state of Utah:
             13          Section 1. JR-16.03 is amended to read:
             14           JR-16.03. Code of Official Conduct.
             15          In judging its members, the Senate and House Ethics Committees have the following
             16      guidelines:
             17          (1) (a) Members of the Senate and House shall not engage in any employment or other
             18      activity that would destroy or impair their independence of judgment.
             19          (b) Members of the Senate and House may not be paid by a person, as defined in Joint
             20      Rule 16.06, to lobby, consult, or to further the interests of any legislation or legislative matter.
             21          (2) Members of the Senate and House shall not exercise any undue influence on any
             22      governmental entity.
             23          (3) Members of the Senate and House shall not engage in any activity that would be an
             24      abuse of official position or a violation of trust.
             25          (4) Members of the Senate and House may engage in business or professional activity in
             26      competition with others, but shall not use any information obtained by reason of their official
             27      position to gain advantage over any competition for activities with the state and its political


             28      subdivisions.
             29          (5) Members of the Senate and House shall not engage in any business relationship or
             30      activity that would require the disclosure of confidential information obtained because of their
             31      official position.
             32          (6) Members of the Senate and House shall not use their official position to secure
             33      privileges for themselves or others.
             34          (7) While in session, members of the Senate and House shall disclose any conflict of
             35      interest on any legislation or legislative matter as provided in JR-16.05.
             36          (8) Members of the Senate and House may accept small gifts, awards, or contributions if
             37      these favors do not influence them in the discharge of official duties.
             38          (9) Members of the Senate and the House may engage in business or professional activities
             39      with the state or its political subdivisions if the activities are entered into under the same
             40      conditions and in the same manner applicable to any private citizen or company engaged in similar
             41      activities. Legislators may enter into transactions with the state by contract [after public notice and
             42      competitive bidding] by following the procedures and requirements of Title 63, Chapter 56, Utah
             43      Procurement Code.
             44          Section 2. Effective date.
             45          This resolution takes effect upon approval by a constitutional majority vote of all members
             46      of the Senate and House of Representatives.
