First Substitute S.B. 198

Senator Terry R. Spencer proposes to substitute the following bill:

HIGH-LEVEL NUCLEAR WASTE

             6      This act appropriates, over two fiscal years, S [ $1,600,000 ] $1,300,000 s from the General Fund
             6a      to the
             7      Department of Environmental Quality to be used to oppose the off site storage of high-level
             8      or greater than class C nuclear waste within the exterior boundaries of the state. This act
             9      appropriates S [ $600,000 ] $300,000 s as a one-time appropriation for fiscal year 2000-01, and
             9a      the effective
             10      date for this appropriation is April 30, 2001. This act also appropriates h [ $1,000,000 ]
             10a      $800,000 h as an
             11      ongoing appropriation for fiscal year 2001-02, and the effective date for this appropriation
             12      is July 1, 2001. Both appropriations are nonlapsing.
             13      This act enacts uncodified material.
             14      Be it enacted by the Legislature of the state of Utah:
             15          Section 1. Appropriation for fiscal year 2000-01.
             16          (1) For fiscal year 2000-01 only, there is appropriated S [ $600,000 ] $300,000 s from the
             16a      General Fund
             17      to the Department of Environmental Quality.
             18          (2) It is the intent of the Legislature that this appropriation be used by the department,
             19      acting in consultation with the office of the governor, to oppose and prevent h , INCLUDING BY
             19a      MEANS OF ECONOMIC DEVELOPMENT:
             19b          (a) h the off site storage
             20      h [ or transportation ] h of high-level or greater than class C nuclear waste within the exterior borders
             20a      of
             21      the state h [ . ] ; AND h


             21a           h (b) THE TRANSPORTATION OF THIS WASTE WITHIN THE STATE FOR DELIVERY TO ANY
             21b      STORAGE SITE LOCATED WITHIN THE EXTERIOR BORDERS OF THE STATE. h    
             22          (3) This appropriation is nonlapsing.
             23          Section 2. Appropriation for fiscal year 2001-02.
             24          (1) For fiscal year 2001-02, there is appropriated, as an ongoing appropriation,
             24a      h [ $1,000,000 ] $800,000 h
             25      from the General Fund to the Department of Environmental Quality.


             26          (2) It is the intent of the Legislature that this appropriation be used by the department,
             27      acting in consultation with the office of the governor, to oppose and prevent h , INCLUDING BY
             27a      MEANS OF ECONOMIC DEVELOPMENT:
             27b          (a) h the off site storage
