6 This act modifies Transportation Code provisions to amend the membership and certain
7 duties of the Traffic Management Committee.
8 This act affects sections of Utah Code Annotated 1953 as follows:
9 AMENDS:
10 72-6-115, as last amended by Chapter 270, Laws of Utah 1999
11 Be it enacted by the Legislature of the state of Utah:
12 Section 1. Section 72-6-115 is amended to read:
13 72-6-115. Traffic Management Committee -- Appointment -- Duties.
14 (1) As used in this section, "committee" means the Traffic Management Committee
15 created in this section.
16 (2) (a) There is created within the Department of Transportation the Traffic Management
17 Committee comprising [
18 flow, [
19 (i) [
20 (ii) one member designated by the Utah Association of Counties;
21 (iii) one member designated by the Department of Environmental Quality;
22 (iv) one member designated by the Wasatch Front Regional Council;
23 (v) one member designated by the Mountainland Association of Governments;
24 (vi) one member designated by the Commissioner of Public Safety; and
25 (vii) one member designated by the Utah League of Cities and Towns[
26 (viii) one member designated by the general manager of a public transit district with more
27 than 200,000 people residing within the public transit district boundaries;
28 (ix) up to four additional members designated by the committee for one-year terms; and
29 (x) a designating entity under Subsections (2)(a)(i) through (viii) may designate an
30 alternative member to serve in the absence of its designated member.
31 (b) The committee shall:
32 (i) advise the department on matters related to the implementation and administration of
33 this section;
34 (ii) make recommendations to law enforcement agencies related to traffic flow and
35 incident management during heavy traffic periods;
36 (iii) make recommendations to the department, counties, and municipalities on increasing
37 the safety and efficiency of highways using current traffic management systems, including traffic
38 signal coordination, traffic monitoring, freeway ramp metering, variable message signing, and
39 incident management; and
40 (iv) evaluate the cost effectiveness of implementing a specific traffic management system
41 on a highway considering:
42 (A) existing traffic volume in the area;
43 (B) the necessity and potential of reducing vehicle emissions in the area;
44 (C) the feasibility of the traffic management system on the highway; and
45 (D) whether traffic congestion will be reduced by the system.

61 compensation or benefits for their services, but may receive per diem and expenses incurred in the
62 performance of the member's official duties at the rates established by the Division of Finance
63 under Sections 63A-3-106 and 63A-3-107 .
64 (B) Members may decline to receive per diem and expenses for their service.
65 (ii) (A) State government officer and employee members who do not receive salary, per
66 diem, or expenses from their agency for their service may receive per diem and expenses incurred
67 in the performance of their official duties from the committee at the rates established by the
68 Division of Finance under Sections 63A-3-106 and 63A-3-107 .
69 (B) State government officer and employee members may decline to receive per diem and
70 expenses for their service.
71 (iii) (A) Local government members who do not receive salary, per diem, or expenses from
72 the entity that they represent for their service may receive per diem and expenses incurred in the
73 performance of their official duties at the rates established by the Division of Finance under
74 Sections 63A-3-106 and 63A-3-107 .
75 (B) Local government members may decline to receive per diem and expenses for their
76 service.
77 (3) (a) The Department of Transportation shall implement and administer traffic
78 management systems to facilitate the efficient flow of motor vehicle traffic on state highways to
79 improve regional mobility, and to reduce motor vehicle emissions where those improvements are
80 cost effective, as determined by the committee in accordance with criteria under Subsection (2)(b).
81 (b) A traffic management system shall be designed to allow safe, efficient, and effective:
82 (i) integration of existing traffic management systems;
83 (ii) additions of highways and intersections under county and city administrative
84 jurisdiction;
85 (iii) incorporation of other traffic management systems; and
86 (iv) adaptation to future traffic needs.
87 (4) (a) The cost of implementing and administering a traffic management system shall be
88 shared pro rata by the department and the counties and municipalities using it.
89 (b) The department shall enter into an agreement or contract under Title 11, Chapter 13,
90 Interlocal Cooperation Act, with a county or municipality to share costs incurred under this section.
91 (5) Additional highways and intersections under the administrative jurisdiction of a county
92 or municipality may be added to a traffic management system upon application of the county or
93 municipality after:
94 (a) a recommendation of the committee;
95 (b) approval by the department;
96 (c) determination of the appropriate cost share of the addition under Subsection (4)(a); and
97 (d) an agreement under Subsection (4)(b).
98 (6) The committee may establish technical advisory committees as needed to assist in
99 accomplishing its duties under this section.
