5 This concurrent resolution of the Legislature and the Governor gives approval for the
6 operation of a h [
6a EXCLUSIVELY s
6a construction
7 and demolition waste. The resolution follows approval to operate the landfill previously
8 granted by the Department of Environmental Quality.
9 Be it resolved by the Legislature of the state of Utah, the Governor concurring therein:
10 WHEREAS, Bear Construction Services Inc. (Bear Construction) desires to operate a new
11 h [
11a construction and
11a demolition
12 waste, as defined in Section 19-6-102 ;
13 WHEREAS, the site where Bear Construction desires to locate the h [
14 landfill is two miles south of the town of Fairfield, on Allens Ranch Road in Cedar Valley in Utah
15 County, and the facility is to be known as the Cedar Valley Landfill;
16 WHEREAS, Section 19-6-108 of the Utah Code requires that an applicant for authority to
17 operate a commercial landfill receive approval from the Utah State Legislature and the Governor
18 of the State as a part of the approval process;
19 WHEREAS, Section 19-6-108 of the Utah Code also requires that an applicant for
20 authority to operate a commercial landfill receive approval from the executive secretary of the
21 Solid and Hazardous Waste Control Board within the Department of Environmental Quality prior
22 to receiving legislative and gubernatorial approval; and
23 WHEREAS, Bear Construction has submitted an application for the operation of a h [

25 approved by the executive secretary of the Solid and Hazardous Waste Control Board in October
26 of 2000, and the approval has an effective date of November 1, 2000:
27 NOW, THEREFORE, BE IT RESOLVED by the Legislature, the Governor concurring
28 therein, that Bear Construction Services Inc. is granted approval to operate a

29 nonhazardous solid waste landfill in Cedar Valley for the purpose of receiving S [
29a EXCLUSIVELY s construction
30 and demolition waste h , AS DEFINED IN 19-6-102. ANY OTHER TYPES OF WASTE
30a REQUIRE ADDITIONAL LEGISLATIVE APPROVAL h .
