H.C.R. 101 Enrolled
This concurrent resolution of the Legislature and the Governor gives approval for the
operation of a landfill in Cedar Valley in Utah County, to receive exclusively construction
and demolition waste. The resolution follows approval to operate the landfill previously
granted by the Department of Environmental Quality.
Be it resolved by the Legislature of the state of Utah, the Governor concurring therein:
WHEREAS, Bear Construction Services Inc. (Bear Construction) desires to operate a new
commercial landfill under Section 19-6-108 to receive exclusively construction and demolition
waste, as defined in Section 19-6-102 ;
WHEREAS, the site where Bear Construction desires to locate the commercial landfill is
two miles south of the town of Fairfield, on Allens Ranch Road in Cedar Valley in Utah County,
and the facility is to be known as the Cedar Valley Landfill;
WHEREAS, Section 19-6-108 of the Utah Code requires that an applicant for authority to
operate a commercial landfill receive approval from the Utah State Legislature and the Governor
of the State as a part of the approval process;
WHEREAS, Section 19-6-108 of the Utah Code also requires that an applicant for
authority to operate a commercial landfill receive approval from the executive secretary of the Solid
and Hazardous Waste Control Board within the Department of Environmental Quality prior to
receiving legislative and gubernatorial approval; and
WHEREAS, Bear Construction has submitted an application for the operation of a
commercial landfill to the Department of Environmental Quality, and that application was approved
by the executive secretary of the Solid and Hazardous Waste Control Board in October of 2000,
and the approval has an effective date of November 1, 2000:
NOW, THEREFORE, BE IT RESOLVED by the Legislature, the Governor concurring
therein, that Bear Construction Services Inc. is granted approval to operate a commercial
nonhazardous solid waste landfill in Cedar Valley for the purpose of receiving exclusively
construction and demolition waste, as defined in Section 19-6-102. Any other types of waste require
additional legislative approval.
