H.B. 39 Enrolled
This act modifies the Criminal Code by specifying additional crimes that are not subject to
statutes of limitations for prosecution.
This act affects sections of Utah Code Annotated 1953 as follows:
AMENDS:
76-1-301, as last amended by Chapter 232, Laws of Utah 1995
76-1-301.5, as last amended by Chapter 155, Laws of Utah 1998
Be it enacted by the Legislature of the state of Utah:
Section 1. Section 76-1-301 is amended to read:
76-1-301. Offenses for which prosecution may be commenced at any time.
A prosecution for a capital felony, aggravated murder, murder, [
abuse homicide which is a second degree felony, aggravated kidnapping, or child kidnapping may
be commenced at any time.
Section 2. Section 76-1-301.5 is amended to read:
76-1-301.5. Time limitations for prosecution of misusing public monies, falsification
or alteration of government records, and bribery.
(1) A prosecution for misusing public monies, falsification or alteration of government
records, or for a bribery offense shall be commenced within two years after facts constituting the
offense have been reported to a prosecutor having responsibility and jurisdiction to prosecute the
offense.
(2) This section does not shorten the limitation of actions under Section 76-1-302 or
Subsection 76-1-303 (3).
