RESOLUTION APPROVING LANDFILL FOR

                 
CONSTRUCTION AND DEMOLITION DEBRIS

                  This concurrent resolution of the Legislature and the Governor gives approval for the
                  operation of a Class V landfill to receive only construction and demolition waste. The
                  landfill is known as the Lost Creek Landfill and it will be located near Circleville in Garfield
                  County. This resolution follows approval to operate the landfill granted by the Department
                  of Environmental Quality.
                  Be it resolved by the Legislature of the state of Utah, the Governor concurring therein:
                      WHEREAS, Dalton Brothers Trucking desires to operate a new Class V commercial
                  landfill under Section 19-6-108 to receive only construction and demolition waste, as defined in
                  Section 19-6-102 ;
                      WHEREAS, the facility is to be known as the Lost Creek Landfill;
                      WHEREAS, the site where Dalton Brothers Trucking desires to locate the Class V
                  commercial landfill is a ten acre parcel in the northeast quarter of Section 2, Township 31 South,
                  Range 4 West, Salt Lake Base and Meridian, and the site is in Garfield County, approximately
                  1,478 feet south of the Piute County and Garfield County boundary;
                      WHEREAS, Section 19-6-108 of the Utah Code requires that an applicant for authority to
                  operate a commercial landfill receive approval from the Utah State Legislature and the Governor
                  of the State as a part of the approval process;
                      WHEREAS, Section 19-6-108 of the Utah Code also requires that an applicant for
                  authority to operate a commercial landfill receive approval from the executive secretary of the
                  Solid and Hazardous Waste Control Board within the Department of Environmental Quality prior
                  to receiving legislative and gubernatorial approval; and
                      WHEREAS, Dalton Brothers Trucking has submitted an application for the operation of
                  this Class V commercial landfill to the Department of Environmental Quality, and that application
                  was approved by the executive secretary of the Solid and Hazardous Waste Control Board on


                  January 30, 2002, and the approval has an effective date of February 15, 2002:
                      NOW, THEREFORE, BE IT RESOLVED by the Legislature, the Governor concurring
                  therein, that Dalton Brothers Trucking is granted approval to operate a Class V commercial
                  nonhazardous solid waste landfill in Circleville, Utah for the purpose of receiving only construction
                  and demolition waste.
