             6      This act modifies the Public Safety Code to repeal the Utah Communications Agency
             7      Network and move its functions into a division of the Department of Public Safety. This act
             8      creates the Public Safety Communications Network Division to be the lead agency to develop,
             9      implement, administer, and maintain the Utah Public Safety Communications Network to
             10      coordinate communications between public safety agencies. This act creates the Utah Public
             11      Safety Communications Network Committee to advise the division. This act requires cost
             12      sharing between agencies involved in the network. This act takes effect on July 1, 2002.
             13      This act affects sections of Utah Code Annotated 1953 as follows:

             46      Be it enacted by the Legislature of the state of Utah:
             47          Section 1. Section 53-14-101 is enacted to read:

CHAPTER 14. UTAH PUBLIC SAFETY COMMUNICATIONS NETWORK ACT

             49     
Part 1. General Provisions

             50          53-14-101. Title.
             51          This chapter is known as the "Utah Public Safety Communications Network Act."
             52          Section 2. Section 53-14-102 is enacted to read:
             53          53-14-102. Definitions.
             54          As used in this chapter:
             55          (1) "Committee" means the Utah Public Safety Communications Network Committee
             56      created in Section 53-14-301 .
             57          (2) "Division" means the Public Safety Communications Division created in Section
             58      53-14-201 .


             59          (3) "Network" means the Utah Public Safety Communications Network established under
             60      Section 53-14-201 .
             61          Section 3. Section 53-14-103 is enacted to read:
             62          53-14-103. Establishment of the Public Safety Communications Division -- Duties.
             63          (1) There is created within the department the "Public Safety Communications Division,"
             64      which was formerly the Utah Communications Agency Network.
             65          (2) The division shall:
             66          (a) be the lead agency to develop, implement, administer, and maintain the network to
             67      provide public safety communications services and facilities on a regional or statewide basis for
             68      the benefit and use of municipal, county, state, and federal government agencies;
             69          (b) assume the operations, contracts, and obligations of the network on July 1, 2002;
             70          (c) coordinate with public agencies to link public safety and emergency services agencies
             71      together through a single communications system network to be known as the Utah Public Safety
             72      Communications Network;
             73          (d) in accordance with Title 11, Chapter 13, Interlocal Cooperation Act, enter into
             74      agreements or contracts with government agencies to:
             75          (i) implement this chapter; and
             76          (ii) share the costs of implementing and administering the network as provided in Section
             77      53-14-401 ; and
             78          (e) in accordance with Title 63, Chapter 46a, Utah Administrative Rulemaking Act, make
             79      rules, with committee approval, as necessary to implement this chapter.
             80          Section 4. Section 53-14-201 is enacted to read:
             81     
Part 2. Committee

             82          53-14-201. Utah Public Safety Communications Network Committee -- Appointment
             83      --Duties -- Per diem -- Technical committees.
             84          (1) There is created within the Department of Public Safety the Utah Public Safety
             85      Communications Network Committee comprising up to 11 members knowledgeable about public
             86      safety communications and the networking of communications systems as follows:
             87          (a) three members designated by the commissioner of public safety;
             88          (b) two members designated by the Utah Sheriff's Association;
             89          (c) one member designated by the Department of Administrative Services;


             90          (d) two members designated by the Utah Police Chief's Association;
             91          (e) up to three additional members designated by the committee for one-year terms; and
             92          (f) a designating entity under Subsections (1)(a) through (1)(d) may designate an
             93      alternative member to serve in the absence of its designated member.
             94          (2) The committee shall:
             95          (a) advise the division on matters related to the implementation and administration of this
             96      chapter;
             97          (b) make recommendations to public safety agencies related to coordinating
             98      communications;
             99          (c) make recommendations to the department, counties, and municipalities on increasing
             100      the efficiency and effectiveness of the network, including development, implementation,
             101      administration, maintenance, and coordination;
             102          (d) evaluate the cost effectiveness of implementing network improvements;
             103          (e) develop broad policies for the long-term development, construction, and operation of
             104      the network;
             105          (f) review and approve contracts and other instruments prior to the division executing them
             106      on behalf of the network; and
             107          (g) review and approve rules proposed by the division.
             108          (3) The committee shall annually elect a chair and a vice chair from its members.
             109          (4) Each member of the committee shall serve until the appointing authority removes the
             110      member, which may be for any reason. When a vacancy occurs in the membership appointed
             111      under Subsections (1)(a) through (d) for any reason, a replacement shall be appointed.
             112          (5) The committee shall meet as it determines necessary to accomplish its duties.
             113          (6) Reasonable notice shall be given to each member of the committee prior to any
             114      meeting.
             115          (7) A majority of the committee constitutes a quorum for the transaction of business.
             116          (8) (a) (i) Members who are not government employees may not receive compensation or
             117      benefits for their services, but may receive per diem and expenses incurred in the performance of
             118      the member's official duties at the rates established by the Division of Finance under Sections
             119      63A-3-106 and 63A-3-107 .
             120          (ii) Members may decline to receive per diem and expenses for their service.


             121          (b) (i) State government officer and employee members who do not receive salary, per
             122      diem, or expenses from their agency for their service may receive per diem and expenses incurred
             123      in the performance of their official duties from the committee at the rates established by the
             124      Division of Finance under Sections 63A-3-106 and 63A-3-107 .
             125          (ii) State government officer and employee members may decline to receive per diem and
             126      expenses for their service.
             127          (c) (i) Local government members who do not receive salary, per diem, or expenses from
             128      the entity that they represent for their service may receive per diem and expenses incurred in the
             129      performance of their official duties at the rates established by the Division of Finance under
             130      Sections 63A-3-106 and 63A-3-107 .
             131          (ii) Local government members may decline to receive per diem and expenses for their
             132      service.
             133          (9) The committee may establish technical advisory committees as needed to assist in
             134      accomplishing its duties under this section.
             135          Section 5. Section 53-14-301 is enacted to read:
             136     
Part 3. Cost Sharing

             137          53-14-301. Cost sharing -- Additional agencies.
             138          (1) (a) The cost of implementing and administering the network shall be shared pro rata
             139      by the division and the counties and municipalities using it.
             140          (b) The division shall enter into an agreement or contract under Title 11, Chapter 13,
             141      Interlocal Cooperation Act, with a county or municipality to share costs incurred under this section.
             142          (2) Additional county and municipal public safety agencies may be added to the network
             143      upon application of a county or municipality after:
             144          (a) a recommendation of the committee;
             145          (b) approval by the division;
             146          (c) determination of the appropriate cost share of the addition under Subsection (1)(a); and
             147          (d) an agreement under Subsection (1)(b).
             148          Section 6. Section 63-38-2 is amended to read:
             149           63-38-2. Governor to submit budget to Legislature -- Contents -- Preparation --
             150      Appropriations based on current tax laws and not to exceed estimated revenues.
             151          (1) (a) The governor shall, within three days after the convening of the Legislature in the


             152      annual general session, submit a budget for the ensuing fiscal year by delivering it to the presiding
             153      officer of each house of the Legislature together with a schedule for all of the proposed
             154      appropriations of the budget, clearly itemized and classified.
             155          (b) The budget message shall include a projection of estimated revenues and expenditures
             156      for the next fiscal year.
             157          (2) At least 34 days before the submission of any budget, the governor shall deliver a
             158      confidential draft copy of his proposed budget recommendations to the Office of the Legislative
             159      Fiscal Analyst.
             160          (3) (a) The budget shall contain a complete plan of proposed expenditures and estimated
             161      revenues for the next fiscal year based upon the current fiscal year state tax laws and rates.
             162          (b) The budget may be accompanied by a separate document showing proposed
             163      expenditures and estimated revenues based on changes in state tax laws or rates.
             164          (4) The budget shall be accompanied by a statement showing:
             165          (a) the revenues and expenditures for the last fiscal year;
             166          (b) the current assets, liabilities, and reserves, surplus or deficit, and the debts and funds
             167      of the state;
             168          (c) an estimate of the state's financial condition as of the beginning and the end of the
             169      period covered by the budget;
             170          (d) a complete analysis of lease with an option to purchase arrangements entered into by
             171      state agencies;
             172          (e) the recommendations for each state agency for new full-time employees for the next
             173      fiscal year; which recommendation should be provided also to the State Building Board under
             174      Subsection 63A-5-103 (2);
             175          (f) any explanation the governor may desire to make as to the important features of the
             176      budget and any suggestion as to methods for the reduction of expenditures or increase of the state's
             177      revenue; and
             178          (g) the information detailing certain regulatory fee increases required by Section 63-38-3.2 .
             179          (5) The budget shall include an itemized estimate of the appropriations for:
             180          (a) the Legislative Department as certified to the governor by the president of the Senate
             181      and the speaker of the House;
             182          (b) the Executive Department;


             183          (c) the Judicial Department as certified to the governor by the state court administrator;
             184          (d) payment and discharge of the principal and interest of the indebtedness of the state [of
             185      Utah];
             186          (e) the salaries payable by the state under the Utah Constitution or under law for the lease
             187      agreements planned for the next fiscal year;
             188          (f) other purposes that are set forth in the Utah Constitution or under law; and
             189          (g) all other appropriations.
             190          (6) Deficits or anticipated deficits shall be included in the budget.
             191          (7) (a) (i) For the purpose of preparing and reporting the budget, the governor shall require
             192      from the proper state officials, including public and higher education officials, all heads of
             193      executive and administrative departments and state institutions, bureaus, boards, commissions, and
             194      agencies expending or supervising the expenditure of the state moneys, and all institutions
             195      applying for state moneys and appropriations, itemized estimates of revenues and expenditures.
             196      The entities required by this Subsection (7)(a)(i) to submit itemized estimates of revenues and
             197      expenditures to the governor, shall also report to the Utah Information Technology Commission
             198      created in Title 63D, Chapter 1, Information Technology Act, before October 30 of each year. The
             199      report to the Information Technology Commission shall include the proposed information
             200      technology expenditures and objectives, the proposed appropriation requests and other sources of
             201      revenue necessary to fund the proposed expenditures and an analysis of:
             202          (A) the entity's need for appropriations for information technology;
             203          (B) how the entity's development of information technology coordinates with other state
             204      or local government entities;
             205          (C) any performance measures used by the entity for implementing information technology
             206      goals; and
             207          (D) any efforts to develop public/private partnerships to accomplish information
             208      technology goals.
             209          (ii) (A) The governor may also require other information under these guidelines and at
             210      times as the governor may direct.
             211          (B) These guidelines may include a requirement for program productivity and performance
             212      measures, where appropriate, with emphasis on outcome indicators.
             213          (b) The estimate for the Legislative Department as certified by the presiding officers of


             214      both houses shall be included in the budget without revision by the governor. Before preparing
             215      the estimates for the Legislative Department, the Legislature shall report to the Information
             216      Technology Commission the proposed information technology expenditures and objectives, the
             217      proposed appropriation requests and other sources of revenue necessary to fund the proposed
             218      expenditures, including an analysis of:
             219          (i) the Legislature's implementation of information technology goals;
             220          (ii) any coordination of information technology with other departments of state and local
             221      government;
             222          (iii) any efforts to develop public/private partnerships to accomplish information
             223      technology goals; and
             224          (iv) any performance measures used by the entity for implementing information technology
             225      goals.
             226          (c) The estimate for the Judicial Department, as certified by the state court administrator,
             227      shall also be included in the budget without revision, but the governor may make separate
             228      recommendations on it. Before preparing the estimates for the Judicial Department, the state court
             229      administrator shall report to the Information Technology Commission the proposed information
             230      technology expenditures and objectives, the proposed appropriation requests and other sources of
             231      revenue necessary to fund the proposed expenditures, including an analysis of:
             232          (i) the Judicial Department's information technology goals;
             233          (ii) coordination of information technology statewide between all courts;
             234          (iii) any efforts to develop public/private partnerships to accomplish information
             235      technology goals; and
             236          (iv) any performance measures used by the entity for implementing information technology
             237      goals.
             238          (d) Before preparing the estimates for the State Office of Education, the state
             239      superintendent shall report to the Information Technology Commission the proposed information
             240      technology expenditures and objectives, the proposed appropriation requests and other sources of
             241      revenue necessary to fund the proposed expenditures, including an analysis of:
             242          (i) the Office of Education's information technology goals;
             243          (ii) coordination of information technology statewide between all public schools;
             244          (iii) any efforts to develop public/private partnerships to accomplish information


             245      technology goals; and
             246          (iv) any performance measures used by the Office of Education for implementing
             247      information technology goals.
             248          (e) Before preparing the estimates for the state system of Higher Education, the
             249      commissioner shall report to the Information Technology Commission the proposed information
             250      technology expenditures and objectives, the proposed appropriation requests and other sources of
             251      revenue necessary to fund the proposed expenditures, including an analysis of:
             252          (i) Higher Education's information technology goals;
             253          (ii) coordination of information technology statewide within the state system of higher
             254      education;
             255          (iii) any efforts to develop public/private partnerships to accomplish information
             256      technology goals; and
             257          (iv) any performance measures used by the state system of higher education for
             258      implementing information technology goals.
             259          (f) The governor may require the attendance at budget meetings of representatives of
             260      public and higher education, state departments and institutions, and other institutions or individuals
             261      applying for state appropriations.
             262          (g) The governor may revise all estimates, except those relating to the Legislative
             263      Department, the Judicial Department, and those providing for the payment of principal and interest
             264      to the state debt and for the salaries and expenditures specified by the Utah Constitution or under
             265      the laws of the state.
             266          (8) The total appropriations requested for expenditures authorized by the budget may not
             267      exceed the estimated revenues from taxes, fees, and all other sources for the next ensuing fiscal
             268      year.
             269          (9) If any item of the budget as enacted is held invalid upon any ground, the invalidity does
             270      not affect the budget itself or any other item in it.
             271          (10) (a) In submitting the budgets for the Departments of Health and Human Services and
             272      the Office of the Attorney General, the governor shall consider a separate recommendation in his
             273      budget for funds to be contracted to:
             274          (i) local mental health authorities under Section 17A-3-606 ;
             275          (ii) local substance abuse authorities under Section 62A-8-110.5 ;


             276          (iii) area agencies under Section 62A-3-104.2 ;
             277          (iv) programs administered directly by and for operation of the Divisions of Mental Health,
             278      Substance Abuse, and Aging and Adult Services;
             279          (v) local health departments under Title 26A, Chapter 1, Local Health Departments; and
             280          (vi) counties for the operation of Children's Justice Centers under Section 67-5b-102 .
             281          (b) In his budget recommendations under Subsections (10)(a)(i), (ii), and (iii), the governor
             282      shall consider an amount sufficient to grant local health departments, local mental health
             283      authorities, local substance abuse authorities, and area agencies the same percentage increase for
             284      wages and benefits that he includes in his budget for persons employed by the state.
             285          (c) If the governor does not include in his budget an amount sufficient to grant the increase
             286      described in Subsection (10)(b), he shall include a message to the Legislature regarding his reason
             287      for not including that amount.
             288          (11) (a) In submitting the budget for the Division of Services for People with Disabilities,
             289      the Division of Child and Family Services, and the Division of Youth Corrections within the
             290      Department of Human Services, the governor shall consider an amount sufficient to grant
             291      employees of corporations that provide direct services under contract with those divisions, the
             292      same percentage increase for cost-of-living that he includes in his budget for persons employed
             293      by the state.
             294          (b) If the governor does not include in his budget an amount sufficient to grant the increase
             295      described in Subsection (11)(a), he shall include a message to the Legislature regarding his reason
             296      for not including that amount.
             297          (12) (a) The Families, Agencies, and Communities Together Council may propose to the
             298      governor under Subsection 63-75-4 (4)(e) a budget recommendation for collaborative service
             299      delivery systems operated under Section 63-75-6.5 .
             300          (b) The Legislature may, through a specific program schedule, designate funds
             301      appropriated for collaborative service delivery systems operated under Section 63-75-6.5 .
             302          [(13) The governor shall include in his budget the state's portion of the budget for the Utah
             303      Communications Agency Network established in Title 63C, Chapter 7, Utah Communications
             304      Agency Network Act.]
             305          Section 7. Section 63-95-102 is amended to read:
             306           63-95-102. Definitions.


             307          For purposes of this chapter:
             308          (1) "Asset" means property of all kind, real and personal, tangible and intangible, and
             309      includes:
             310          (a) cash, except reasonable compensation or salary for services rendered;
             311          (b) stock or other investments;
             312          (c) goodwill;
             313          (d) real property;
             314          (e) an ownership interest;
             315          (f) a license;
             316          (g) a cause of action; and
             317          (h) any similar property.
             318          (2) "Authorizing statutes" means the statutes creating an entity as a quasi-governmental
             319      entity.
             320          (3) "Business interest" means:
             321          (a) holding the position of trustee, director, officer, or other similar position with a
             322      business entity; or
             323          (b) the ownership, either legally or equitably, of at least 10% of the outstanding shares of
             324      a corporation or 10% interest in any other business entity, being held by:
             325          (i) an individual;
             326          (ii) the individual's spouse;
             327          (iii) a minor child of the individual; or
             328          (iv) any combination of Subsections (3)(b)(i) through (iii).
             329          (4) "Committee" means the Legislative Quasi-Governmental Entities Committee created
             330      in Section 63-95-201 .
             331          (5) "Government requestor" means:
             332          (a) the governor;
             333          (b) an executive branch officer other than the governor;
             334          (c) an executive branch agency;
             335          (d) a legislator, including a legislative sponsor of legislation creating a quasi-governmental
             336      entity; or
             337          (e) a legislative committee.


             338          (6) "Interested party" means a person that held or holds the position of trustee, director,
             339      officer, or other similar position with a quasi-governmental entity within:
             340          (a) five years prior to the date of an action described in Subsection (8); or
             341          (b) during the privatization of a quasi-governmental entity.
             342          (7) "Lobbyist" is a person that provided or provides services as a lobbyist, as defined in
             343      Section 36-11-102 , within:
             344          (a) five years prior to the date of an action described in Subsection (8); or
             345          (b) during the privatization of a quasi-governmental entity.
             346          (8) (a) "Privatized" means an action described in Subsection (8)(b) taken under
             347      circumstances in which the operations of the quasi-governmental entity are continued by a
             348      successor entity that:
             349          (i) is privately owned;
             350          (ii) is unaffiliated to the state; and
             351          (iii) receives any asset of the quasi-governmental entity.
             352          (b) An action referred to in Subsection (8)(a) includes:
             353          (i) the repeal of the authorizing statute of a quasi-governmental entity and the revision to
             354      state laws to terminate the relationship between the state and the quasi-governmental entity;
             355          (ii) the dissolution of the quasi-governmental entity;
             356          (iii) the merger or consolidation of the quasi-governmental entity with another entity; or
             357          (iv) the sale of all or substantially all of the assets of the quasi-governmental entity.
             358          (9) (a) "Quasi-governmental entity" means an entity that:
             359          (i) is created by the state or is given by the state the right to exist and conduct its affairs
             360      as a quasi-governmental entity:
             361          (A) to serve a public purpose; and
             362          (B) to meet a need that cannot be met through a private business; and
             363          (ii) is designated by the state as:
             364          (A) an independent state agency;
             365          (B) an independent public corporation;
             366          (C) a quasi-public corporation; or
             367          (D) a term similar to that described in Subsections (9)(a)(ii)(A) through (C).
             368          (b) "Quasi-governmental entity" includes the:


             369          (i) Dairy Commission created in Title 4, Chapter 22, Dairy Promotion Act;
             370          (ii) Utah Technology Finance Corporation created in Title 9, Chapter 13, Utah Technology
             371      and Small Business Finance Act;
             372          (iii) Heber Valley Railroad Authority created in Title 9, Chapter 3, Part 3, Heber Valley
             373      Historic Railroad Authority;
             374          (iv) Utah Science Center Authority created in Title 9, Chapter 3, Part 4, Utah Science
             375      Center Authority;
             376          (v) Utah Housing Finance Agency created in Title 9, Chapter 4, Part 9, Utah Housing
             377      [Finance Agency] Corporation Act;
             378          (vi) Utah State Fair Corporation created in Title 9, Chapter 4, Part 11, Utah State Fair
             379      Corporation Act;
             380          (vii) Workers' Compensation Fund created in Title 31A, Chapter 33, Workers'
             381      Compensation Fund;
             382          (viii) Utah State Retirement Office created in Title 49, Chapter 1, Part 2, Retirement Office
             383      and Board; and
             384          (ix) School and Institutional Trust Lands Administration created in Title 53C, Chapter 1,
             385      Part 2, School and Institutional Trust Lands Administration[; and].
             386          [(x) Utah Communications Agency Network created in Title 63C, Chapter 7, Utah
             387      Communications Agency Network Act.]
             388          (c) Notwithstanding Subsection (9)(a), "quasi-governmental entity" does not include:
             389          (i) the Public Service Commission of Utah created in Section 54-1-1 ;
             390          (ii) an institution within the state system of higher education;
             391          (iii) a city, county, or town;
             392          (iv) a local school district;
             393          (v) a special district created under the authority of Title 17A, Special Districts; or
             394          (vi) a local district created under the authority of Title 17B, Limited Purpose Local
             395      Government Entities.
             396          Section 8. Section 63E-1-102 (Effective 07/01/02) is amended to read:
             397           63E-1-102 (Effective 07/01/02). Definitions.
             398          As used in this title:
             399          (1) "Authorizing statute" means the statute creating an entity as an independent entity.


             400          (2) "Committee" means the Legislative Independent Entities Committee created in Section
             401      63E-1-201 .
             402          (3) "Independent corporation" means a corporation incorporated in accordance with
             403      Chapter 2, Independent Corporations Act.
             404          (4) (a) "Independent entity" means an entity having a public purpose relating to the state
             405      or its citizens that is individually created by the state or is given by the state the right to exist and
             406      conduct its affairs as an:
             407          (i) independent state agency; or
             408          (ii) independent corporation.
             409          (b) "Independent entity" includes the:
             410          (i) Dairy Commission created in Title 4, Chapter 22, Dairy Promotion Act;
             411          (ii) Utah Technology Finance Corporation created in Title 9, Chapter 13, Utah Technology
             412      and Small Business Finance Act;

             415          (iv) Utah Science Center Authority created in Title 9, Chapter 3, Part 4, Utah Science
             416      Center Authority;
             417          (v) Utah Housing Finance Agency created in Title 9, Chapter 4, Part 9, Utah Housing
             418      [Finance Agency] Corporation Act;
             419          (vi) Utah State Fair Corporation created in Title 9, Chapter 4, Part 11, Utah State Fair
             420      Corporation Act;
             421          (vii) Workers' Compensation Fund created in Title 31A, Chapter 33, Workers'
             422      Compensation Fund;
             423          (viii) Utah State Retirement Office created in Title 49, Chapter 1, Part 2, Retirement Office
             424      and Board; and
             425          (ix) School and Institutional Trust Lands Administration created in Title 53C, Chapter 1,
             426      Part 2, School and Institutional Trust Lands Administration[; and].
             427          [(x) Utah Communications Agency Network created in Title 63C, Chapter 7, Utah
             428      Communications Agency Network Act.]
             429          (c) Notwithstanding this Subsection (4), "independent entity" does not include:
             430          (i) the Public Service Commission of Utah created in Section 54-1-1 ;


             431          (ii) an institution within the state system of higher education;
             432          (iii) a city, county, or town;
             433          (iv) a local school district;
             434          (v) a special district created under the authority of Title 17A, Special Districts; or
             435          (vi) a local district created under the authority of Title 17B, Limited Purpose Local
             436      Government Entities.
             437          (5) "Independent state agency" means an entity that is created by the state, but is
             438      independent of the governor's direct supervisory control.
             439          (6) "Monies held in trust" means monies maintained for the benefit of:
             440          (a) one or more private individuals, including public employees;
             441          (b) one or more public or private entities; or
             442          (c) the owners of a quasi-public corporation.
             443          (7) "Public corporation" means an artificial person, public in ownership, individually
             444      created by the state as a body politic and corporate for the administration of a public purpose
             445      relating to the state or its citizens.
             446          (8) "Quasi-public corporation" means an artificial person, private in ownership,
             447      individually created as a corporation by the state which has accepted from the state the grant of a
             448      franchise or contract involving the performance of a public purpose relating to the state or its
             449      citizens.
             450          Section 9. Repealer.
             451          This act repeals:

             453      Agency Network.
