First Substitute H.B. 275

Senator Howard A. Stephenson proposes the following substitute bill:

             6      This act modifies the State System of Public Education Code by authorizing the State Board
             7      of Education to reallocate designated appropriations between line items. This act has an
             8      immediate effective date.
             9      This act affects sections of Utah Code Annotated 1953 as follows:
             10      ENACTS:
             11          53A-1-408, Utah Code Annotated 1953
             12      Be it enacted by the Legislature of the state of Utah:
             13          Section 1. Section 53A-1-408 is enacted to read:
             14          53A-1-408. Appropriations reallocation.
             15          (1) Notwithstanding the requirements of Title 63, Chapter 38, Budgetary Procedures Act,
             16      the State Board of Education may reallocate between line items appropriations for the support of
             17      public education for the fiscal year beginning July 1, 2001 and ending June 30, 2002:
             18          (a) as described in Items 231 through 239 in Chapter 334, Laws of Utah 2001; and
             19          (b) as modified by:
             20          (i) Chapter 5, Laws of Utah First Special Session 2001;
             21          (ii) H.B. 1, 2002 General Session; and
             22          (iii) H.B. 3, 2002 General Session.
             23          (2) The total amount of money reallocated under Subsection (1) may not exceed the sum
             24      of the reductions made by H.B. 1, 2002 General Session, and H.B. 3, 2002 General Session.
             25          Section 2. Effective date.


             26          If approved by two-thirds of all the members elected to each house, this act takes effect
             27      upon approval by the governor, or the day following the constitutional time limit of Utah
             28      Constitution Article VII, Section 8, without the governor's signature, or in the case of a veto, the
             29      date of veto override.
