6 This act modifies the Local Health Department Act. The act amends the appointment
7 procedure for local health directors.
8 This act affects sections of Utah Code Annotated 1953 as follows:
9 AMENDS:
10 26A-1-110, as renumbered and amended by Chapter 269, Laws of Utah 1991
11 Be it enacted by the Legislature of the state of Utah:
12 Section 1. Section 26A-1-110 is amended to read:
13 26A-1-110. Local health officer -- Powers and duties -- Vacancy.
14 (1) [
15 board shall appoint a local health officer and determine the officer's compensation, subject to
16 ratification by the local governing bodies that contribute funds to the local health department.
17 (b) Notwithstanding the provisions of Subsection (1)(a), in a county of the first class, the
18 county executive shall appoint a local health officer and determine the officer's compensation.
19 (2) The board shall determine the general policies to be followed in administration of the
20 local health department. The board shall adopt written procedures to carry out the provisions of
21 this section.
22 (3) The local health officer shall:
23 (a) have the qualifications of training and experience for that office equivalent to those
24 approved by the department for local health officers;
25 (b) be the administrative and executive officer of the local health department and devote
26 full time to the duties of the office;
27 (c) if provisions have been made with the department, act as the local registrar of vital
28 statistics within the local health department's boundaries without additional compensation or
29 payment of fees provided by law;
30 (d) prepare an annual budget and present it to the board for approval prior to the beginning
31 of each fiscal year unless an extension is approved by the board; and
32 (e) prepare an annual report and provide it to the department and all local governing bodies
33 contributing funds to the local health department.
34 (4) The report under Subsection (3)(e) shall contain a copy of the independent financial
35 audit required under Section 26A-1-115 , a description of the population served by the local health
36 department, and other information as requested and approved by the board.
37 (5) In the absence or disability of the local health officer, or if there is a vacancy in that
38 office, the board shall appoint an acting health officer for a temporary period not to exceed one
39 year.
