First Substitute S.B. 142

Senator Lyle W. Hillyard proposes the following substitute bill:

1 HIGHER EDUCATION BUDGET AUTHORITY
2 2002 GENERAL SESSION
3 STATE OF UTAH
4 Sponsor: Lyle W. Hillyard
5 This act modifies the State System of Higher Education Code by authorizing the presidents
6 of the institutions of higher education and the State Board of Regents to reallocate
7 designated appropriations between line items. This act has an immediate effective date.
8 This act affects sections of Utah Code Annotated 1953 as follows:
9 ENACTS:
10 53B-2-107, Utah Code Annotated 1953
11 Be it enacted by the Legislature of the state of Utah:
12 Section 1. Section 53B-2-107 is enacted to read:
13 53B-2-107. Appropriations reallocation.
14 (1) Notwithstanding the requirements of Title 63, Chapter 38, Budgetary Procedures Act,
15 appropriations for the support of higher education for the fiscal year beginning July 1, 2001 and
16 ending June 30, 2002, may be reallocated between line items as provided in this section.
17 (2) (a) The president of the University of Utah may reallocate between line items the
18 appropriations:
19 (i) described in Items 143-150 and Item 152 in Chapter 334, Laws of Utah 2001; and
20 (ii) as modified by:
21 (A) H.B. 1, 2002 General Session; and
22 (B) H.B. 3, 2002 General Session.
23 (b) The total amount of money reallocated may not exceed the sum of the reductions made
24 in H.B. 1, 2002 General Session and H.B. 3, 2002 General Session.
25 (3) (a) The president of Utah State University may reallocate between line items the

26 appropriations:
27 (i) described in Items 154-166 in Chapter 334, Laws of Utah 2001; and
28 (ii) as modified by:
29 (A) H.B. 1, 2002 General Session; and
30 (B) H.B. 3, 2002 General Session.
31 (b) The total amount of money reallocated may not exceed the sum of the reductions made
32 in H.B. 1, 2002 General Session and H.B. 3, 2002 General Session.
33 (4) (a) The president of Weber State University may reallocate between line items the
34 appropriations:
35 (i) described in Items 168 and 169 in Chapter 334, Laws of Utah 2001; and
36 (ii) as modified by:
37 (A) H.B. 1, 2002 General Session; and
38 (B) H.B. 3, 2002 General Session.
39 (b) The total amount of money reallocated may not exceed the sum of the reductions made
40 in H.B. 1, 2002 General Session and H.B. 3, 2002 General Session.
41 (5) (a) The president of Southern Utah University may reallocate between line items the
42 appropriations:
43 (i) described in Items 170-172 in Chapter 334, Laws of Utah 2001; and
44 (ii) as modified by:
45 (A) H.B. 1, 2002 General Session; and
46 (B) H.B. 3, 2002 General Session.
47 (b) The total amount of money reallocated may not exceed the sum of the reductions made
48 in H.B. 1, 2002 General Session and H.B. 3, 2002 General Session.
49 (6) (a) The president of Snow College may reallocate between line items the
50 appropriations:
51 (i) described in Items 173-175 in Chapter 334, Laws of Utah 2001; and
52 (ii) as modified by:
53 (A) H.B. 1, 2002 General Session; and
54 (B) H.B. 3, 2002 General Session.
55 (b) The total amount of money reallocated may not exceed the sum of the reductions made
56 in H.B. 1, 2002 General Session and H.B. 3, 2002 General Session.

57 (7) (a) The president of Dixie State College may reallocate between line items the
58 appropriations:
59 (i) described in Items 177-179 in Chapter 334, Laws of Utah 2001; and
60 (ii) as modified by:
61 (A) H.B. 1, 2002 General Session; and
62 (B) H.B. 3, 2002 General Session.
63 (b) The total amount of money reallocated may not exceed the sum of the reductions made
64 in H.B. 1, 2002 General Session and H.B. 3, 2002 General Session.
65 (8) (a) The president of the College of Eastern Utah may reallocate between line items the
66 appropriations:
67 (i) described in Items 180-183 in Chapter 334, Laws of Utah 2001; and
68 (ii) as modified by:
69 (A) H.B. 1, 2002 General Session; and
70 (B) H.B. 3, 2002 General Session.
71 (b) The total amount of money reallocated may not exceed the sum of the reductions made
72 in H.B. 1, 2002 General Session and H.B. 3, 2002 General Session.
73 (9) (a) The president of Utah Valley State College may reallocate between line items the
74 appropriations:
75 (i) described in Items 184 and 185 in Chapter 334, Laws of Utah 2001; and
76 (ii) as modified by:
77 (A) H.B. 1, 2002 General Session; and
78 (B) H.B. 3, 2002 General Session.
79 (b) The total amount of money reallocated may not exceed the sum of the reductions made
80 in H.B. 1, 2002 General Session and H.B. 3, 2002 General Session.
81 (10) (a) The president of Salt Lake Community College may reallocate between line items
82 the appropriations:
83 (i) described in Items 186-188 in Chapter 334, Laws of Utah 2001; and
84 (ii) as modified by:
85 (A) H.B. 1, 2002 General Session; and
86 (B) H.B. 3, 2002 General Session.
87 (b) The total amount of money reallocated may not exceed the sum of the reductions made

88 in H.B. 1, 2002 General Session and H.B. 3, 2002 General Session.
89 (11) (a) The State Board of Regents may reallocate between line items the appropriations:
90 (i) described in Items 189, 190, and 192-199 in Chapter 334, Laws of Utah 2001; and
91 (ii) as modified by:
92 (A) H.B. 1, 2002 General Session; and
93 (B) H.B. 3, 2002 General Session.
94 (b) The total amount of money reallocated may not exceed the sum of the reductions made
95 in H.B. 1, 2002 General Session and H.B. 3, 2002 General Session.
96 Section 2. Effective date.
97 If approved by two-thirds of all the members elected to each house, this act takes effect
98 upon approval by the governor, or the day following the constitutional time limit of Utah
99 Constitution Article VII, Section 8, without the governor's signature, or in the case of a veto, the
100 date of veto override.
