Chair Bryson called the meeting to order at 8:15 a.m.

1st Sub. H.B. 64    Consumer Protection Amendments (A. Bradshaw)

Rep. Bradshaw introduced the bill.

MOTION: Rep. Bradshaw moved to amend the bill as follows:

1.    Page 4, Line 91:         After "be [determined as follows]" delete "set by the director of the division at a reasonable level" and insert a colon

2.    Page 4, Lines 92, 93:    Delete lines 92, 93

3.    Page 4, Line 94:        After "(i)" delete "$50,000" and insert "$25,000"

4.    Page 4, Line 97:        After "application" insert "and the telephone soliciting business has fewer than ten employees;"

5.    Page 4, Line 98:         Bracket and delete ";or" and after line 98 insert:
                "(ii) $50,000 if neither the telephone soliciting business nor any affiliated person has violated this chapter within three years preceding the date of the application and the telephone soliciting business has ten or more employees; or"

6.    Page 4, Line 99:        At the beginning of line 99 bracket "(ii)" and insert "(iii)"

    The motion passed unanimously with Rep. Adair, Rep. S. Clark, and Rep. Hatch absent for the vote.


MOTION: Rep. Hansen moved to pass the bill out favorably as amended. The motion passed unanimously with Rep. Adair, Rep. S. Clark, and Rep. Hatch absent for the vote.

H.B. 110    Motor Vehicle Insurance and Credit Information (P. Wallace)

Rep. Wallace introduced the bill.

Spoke for the bill:    Clarre Geddes, Utah Legislature Watch

Spoke against the bill:    Willy Graves, Progressive Insurance
            Candace Daly, Credit Bureau Industry

Spoke to the bill:    Merwin Stewart, Insurance Commissioner
            Brad Tibbets, Property and Casualty Division, Department of Insurance

Rep. Biskupski declared a conflict of interest.

MOTION: Rep. King moved to amend the bill as follows:

1.    Page 1, Line 16:        After "(a) " delete ""Consumer" and insert "(i) Except as provided in Subsection (1)(a)(ii), "consumer" and after line 16 insert:
                "(ii) "Consumer report" does not include:
                (A) a motor vehicle record obtained from a state or an agency of     a state; or
                (B) any information regarding an applicant's or insured's     insurance claim history.
"
    
The motion passed unanimously with Rep. Adair, Rep. S. Clark, and Rep. Hatch absent for the vote.

MOTION:
Rep. D. Clark moved to amend the bill as follows:

1.     Page 2, Line 42:        Delete line 42

    The motion passed with Rep. King voting in opposition.

MOTION: Rep. David Clark moved to pass the bill out favorably as amended.

SUBSTITUTE
MOTION:
Rep. Ferry moved to adjourn the meeting. The motion passed with Rep. Adair, Rep. Bradshaw, Rep. S. Clark, Rep. Parker, Rep. Hansen, and Rep. King voting in opposition.

Chair Bryson adjourned the meeting at 10:00 a.m.
