Vice Chair Ben Ferry called the meeting to order at 8:08 a.m.

MOTION: Rep. Biskupski moved to approve the minutes of the January 30, 2002 meeting. The motion passed unanimously with Rep. Adair, Rep. Bradshaw, Rep. Bryson, Rep. S. Clark, and Rep. Morgan absent for the vote.

H.B. 276    Assessment on Title Insurers (Tom Hatch)

Rep. Hatch introduced the bill.

MOTION: Rep. Hatch moved to amend the bill as follows:

1.    Page 2, Line 47:        After "assessed" insert "up to"

    The motion passed unanimously with Rep. Bradshaw and Rep. S. Clark absent for the vote.

MOTION: Rep. Biskupski moved to pass the bill out favorably as amended. The motion passed unanimously with Rep. Bradshaw absent for the vote.

MOTION: Rep. Hatch moved that H.B. 276 be placed on the consent calendar. The motion passed unanimously with Rep. Bradshaw absent for the vote.

Vice Chair Ben Ferry relinquished the chair to Chair Katherine Bryson.


H.C.R. 2    Resolution Supporting Businesses (Greg Curtis)

Rep. Curtis introduced the resolution.

MOTION: Rep. King moved to pass the resolution out favorably. The motion passed unanimously.

MOTION: Rep. Curtis moved that H.C.R. 2 be placed on the consent calendar. The motion passed unanimously.

1st Sub. H.B. 279    Professional Employer Organization Licensing Act Amendments (Greg Curtis)

Rep. Curtis introduced the bill.

MOTION: Rep. Curtis moved to move to the next item on the agenda. The motion passed unanimously.

H.B. 90    Truth in Advertising Amendments (Scott Daniels)

Rep. Daniels introduced the bill.

MOTION: Rep. Adair moved to delete in title and body H.B. 90 and replace it with 1st Sub. H.B. 90 Truth in Advertising Amendments (S. Daniels). The motion passed unanimously with Rep. Bradshaw absent for the vote.

MOTION: Rep. Hansen moved to pass the substitute bill out favorably. The motion passed unanimously with Rep. Bradshaw absent for the vote.

MOTION: Rep. Curtis moved to move back to 1st Sub. H.B. 279 Professional Employer Organization Licensing Act Amendments. The motion passed unanimously with Rep. Bradshaw absent for the vote.

1st Sub. H.B. 279    Professional Employer Organization Licensing Act Amendments (Greg Curtis)

MOTION: Rep. Curtis moved to amend the bill as follows:

1.    Page 8, Line 235:    After "plan;" delete "and"

2.    Page 9, Line 249:    After "trend" delete "." and insert ";"



3.    Page 9, Line 249:    After line 249 insert:
        "(5) provide to the division a statement from the PEO's third party administrator or actuary indicating the run-out, the change in life count, the medical trend, and the statutory liability of the plan, where the plan's statutory liability is the run-out increased by the change in life count, then increased by the medical trend; and
        (6) provide an audited financial statement evidencing that the PEO's plan has excess reserves of at least 50% of its statutory liability held in the plan trust as of the end of the fiscal year of the PEO, and if the excess reserves are not met, the PEO may supplement the proof that it has come into compliance with the requirement.

MOTION: Rep. Morgan moved to pass the bill out favorably. The motion passed with Rep. Adair voting in opposition, and Rep. Curtis and Rep. Hatch absent for the vote.

3rd Sub. H.B. 205    Construction Services Commission (Stephen Clark)

Rep. S. Clark introduced the bill.

Spoke against the bill:    Ken Gardner, Utah AFL-CIO

Spoke for the bill:    Todd Bingham, Associated Builders and Contractors


MOTION: Rep. S. Clark moved to delete in title and body 3rd Sub. H.B. 205 and replace it with 4th Sub. H.B. 205 Construction Services Commission (S. Clark). The motion passed unanimously with Rep. Curtis and Rep. Hatch absent for the vote.

MOTION: Rep. Adair moved to adjourn the meeting. The motion passed with Rep. D. Clark, Rep. S. Clark, Rep. Parker, and Rep. Ferry voting in opposition. Rep. Curtis and Rep. Hatch were absent for the vote.

Chair Katherine Bryson adjourned the meeting at 8:25 a.m.
