Chair Saunders called the meeting to order at 4:34 p.m.

MOTION:    Representative Lockhart moved to approve the minutes of the January 30, 2002 and February 6, 2002 committee meetings. The motion passed unanimously.


H.B. 339    Division of Services for People with Disabilities (R. Lockhart)

Representative Lockhart presented the bill to the committee with a proposed substitute to the bill.

MOTION:    Representative Lockhart moved that 1st Substitute H.B. 339 replace H.B. 339. The motion passed unanimously with Representative Harper and Representative Thompson absent for the vote.

Representative Lockhart explained the substitute bill to the committee.



Speaking in support of the bill were Ms. Terri Stettler and Mr. Gary Watts, Board of Services for People With Disabilities, and Ms. Fraser Nelson, Disability Law Center.

Ms. Robin Arnold-Williams, Executive Director - Department of Human Services, answered questions of committee members regarding the bill.

MOTION:    Representative Ray moved to pass the substitute bill out favorably. The motion passed unanimously with Representative Harper absent for the vote.


2nd Substitute S.B. 113     Rural Dentist Student Loan Repayment Assistance

Senator Knudson explained the bill to the committee.

MOTION:    Representative Mascaro moved to pass the bill out favorably. The motion passed unanimously with Representative Harper absent for the vote.


H.B. 318    Governmental Immunity - Exception for Perjury (M. Throckmorton)

Representative Throckmorton explained the bill to the committee.

MOTION:    Representative Beck moved to pass the bill out favorably. The motion passed unanimously with Representative Harper absent for the vote.

MOTION:    At the request of the sponsor, Representative Ray moved to place the bill on the Consent Calendar. The motion passed unanimously with Representative Harper absent for the vote.


H.B. 314    Combining Divisions of Substance Abuse and Mental Health
(J. Seitz)

Representative Seitz presented the bill to the committee with proposed amendments.

MOTION:    Representative Beck moved to amend the bill as follows:

1.    Page 1, Line 12:        After " date." insert " This act contains a coordinating clause."


2.    Page 183, Line 5644:    After line 5644 insert:
                        "Section 147. Coordination cause.
                         If this bill and S.B. 97, Forensic Mental Health Coordinating Council, both pass, it is the intent of the Legislature that:
                         (1) Section 62A-12-204.6 in S.B. 97 shall be renumbered to Section 62A-15-605.5 ; and
                         (2) in this bill, the cross reference in Subsection 62A-15-610 (2)(g) shall be changed from 62A-15-605 to 62A-15-605.5 . "

        The motion passed unanimously.

Ms. Nora B. Stephens, Board of Substance Abuse; Mr. James Ashworth, Board of Mental Health; and Dr. Michael Crookston, Board of Substance Abuse, spoke in opposition to the bill.

Ms. Robin Arnold-Williams, Executive Director - Department of Human Services, answered questions of committee members regarding the bill.

MOTION:    Representative Mascaro moved that the bill be referred for interim study.

SUBSTITUTE
MOTION:
    Representative Harper moved that the bill be passed out favorably as amended. The motion failed with the voting as follows: Voting no were Representative Beck, Representative Jones, Representative Litvack, Representative Mascaro, Representative Ray, and Representative Thompson. Representative Donnelson, Representative Harper, Representative Lockhart, and Representative Saunders voted yes.

        Voting then took place on the original motion of Representative Mascaro to refer the bill for interim study. The motion passed with Representative Donnelson, Representative Harper, Representative Jones, and Representative Lockhart voting no.


H.B. 310    Mobility Assistance Fund

Representative Hutchings explained the bill to the committee and distributed a handout.

Ms. Sheena Deus, Copper Hills High School Advanced Placement Government Class student, spoke in support of the bill.




MOTION:    Representative Litvack moved to pass the bill out favorably. The motion passed with Representative Harper, Representative Thompson, and Representative Lockhart voting no.


H.B. 298    Child Welfare Enhanced Training
(D. Litvack)

This bill was not considered in today's meeting.

    
MOTION:    Representative Ray moved to adjourn the meeting. The motion passed unanimously.

Chair Saunders adjourned the meeting at 5:40 p.m.
