Chair Bowman called the meeting to order at 8:10 a.m.

MOTION:     Rep. Parker moved to approve the minutes of the January 24, 2002 meeting. The motion passed unanimously, with Rep. Aagard, Rep. Ray, Rep. Seitz, and Rep. Throckmorton absent for the vote.

H.B. 92    Seat Belt Requirements (C. Moss)

Explained the bill:    Rep. Moss
                Rolayne Fairclough, Public Affairs and Legislative Representative, AAA Utah

Spoke for the bill:    Tom Metcalf, Utah Chapter of the American Academy of Pediatrics
                Tim Cosgrove, Child Advocate, Primary Children's Hospital    


MOTION:     Rep. Moss moved to adopt the following amendments:

1.    Page 1, Line 5:    Delete "amending" and insert "repealing"

2.    Page 1, Line 12:    Delete "(1)"

3.    Page 1, Line 13:    Delete "(a)" and insert "(1)"

4.    Page 1, Line 14:    Delete "(b)" and insert "(2)"

5.    Page 1, Line 17:    Delete "(c)" and insert "(3)"

6.    Page 1, Lines 19-21:    Delete lines 19 through 21
    


MOTION:    After committee discussion, Rep. Seitz moved previous question. The motion passed unanimously.

The motion to amend passed, with Rep. Aagard, Rep. Pace, Rep. Seitz, Rep. Throckmorton, and Rep. Winn voting in opposition.

MOTION:    Rep. Bourdeaux moved to pass the amended bill out favorably. The motion passed, with Rep. Aagard, Rep. Pace, Rep. Seitz, Rep. Throckmorton, and Rep. Winn voting in opposition.

Chair Bowman relinquished the chair to Vice Chair Throckmorton.

S.B. 26    Serious Youth Offender Amendments (L. Hillyard)

Explained the bill:    Sen. Hillyard
                Blake Chard, Director, Division of Youth Corrections

MOTION:    Rep. Seitz moved to adopt the following amendments:

1.    Page 1, line 7:    At the end of line 7, insert: "This act takes effect immediately."

2.    Page 7, line 183:    After line 183, insert:
        "Section 4. Effective Date.
        If approved by two-thirds of all the members elected to each house, this act takes effect upon approval by the governor, or the day following the constitutional time limit of Utah Constitution Article VII, Section 8, without the governor's signature, or in the case of a veto, the date of veto override.
"

The motion passed unanimously, with Rep. Moss absent for the vote.

MOTION:    Rep. Bourdeaux moved to pass the amended bill out favorably. The motion passed unanimously, with Rep. Moss absent for the vote.

Vice Chair Throckmorton relinquished the chair to Chair Bowman.

S.B. 40    Tuition Assistance Appropriation for National Guard (P. Knudson)

Sen. Knudson explained the bill.

MOTION:    Rep. Bourdeaux moved to passed the bill out favorably. The motion passed unanimously, with Rep. Moss absent for the vote.


MOTION:    Rep. Pace moved that S.B. 40 be placed on the consent calendar. The motion passed unanimously, with Rep. Moss absent for the vote.

MOTION:    Rep. Beck moved to adjourn the meeting. The motion passed unanimously, with Rep. Moss absent for the vote.
