Chair Gladwell called the meeting to order at 4:20 a.m.
MOTION: Sen. Peterson moved to approve the minutes of February 6, 2002.
The motion passed unanimously with Sen. Buttars and Sen. Valentine absent for the vote.
1. S.B. 171 Uniform Arbitration Act (L. Hillyard)
Sen. Hillyard introduced the bill assisted by Michael Zimmerman, Attorney, Utah Council on Conflict Resolution.
Kent Scott, Attorney, American Bar Association, spoke in favor of the bill.
Lowell Smith, Attorney, Bear River Insurance Co., spoke in opposition to the bill.
Edward Havas, Utah Trial Lawyers Association, spoke in favor of the bill generally but expressed concerns with portions of it.
MOTION: Sen. Suazo moved to pass S.B. 171 out with a favorable recommendation.
The motion passed with Sen. Buttars voting in opposition.
2. S.B. 74 Criminal Action - Defense to Civil Action for Damages (P. Hellewell)
Sen. Parley Hellewell introduced the bill.
MOTION: Sen. Peterson moved to pass S.B. 74 out with a favorable recommendation.
The motion passed unanimously with Sen. Buttars absent for the vote.
3. H.B. 45 Prisoner Escape Amendment (K. Morgan)
Rep. Karen Morgan introduced the bill.
MOTION: Sen. Valentine moved to pass H.B. 45 out with a favorable recommendation.
The motion passed unanimously with Sen. Buttars and Sen. Hillyard absent for the vote.
MOTION: Sen. Peterson moved to adjourn.
The motion passed unanimously with Sen. Buttars and Sen. Hillyard absent for the vote.
Sen. Gladwell adjourned the meeting at 5:25 p.m.
