Sen. Stephenson assumed the Chair and called the meeting to order at 8:10 a.m.

1.     S.B. 154 Use of Rainy Day Funds (P. Hellewell)

    
Sen. Hellewell explained the bill and distributed 1st Sub. S.B. 154 Use of Rainy Day Funds.

     MOTION: Sen. Valentine moved to adopt 1st Sub. S.B. 154.

    The motion passed unanimously with Sen. Bramble and Sen. Hillyard absent for the vote.

    Sen. Bramble resumed the Chair.

    Lynn Vellinga, Assistant Director, Division of Finance, DAS, clarified the bill.

     MOTION: Sen. Stephenson moved to pass the bill out favorably.

    The motion passed with Sen. Bramble, Sen. Hillyard, Sen. Stephenson and Sen. Valentine voting in favor of the bill, and Sen. Allen and Sen. Dmitrich voting in opposition to the bill.

2.     S.B. 68 Utah Procurement Code Amendments (M. Dmitrich)

    
Sen. Dmitrich explained the bill.



    Ken Nye, Program Director, Division of Facilities Construction Management and David Spatafore, Utah League of Cities and Towns spoke in support of the bill.

     MOTION: Sen. Valentine moved to pass the bill out favorably.

    The motion passed unanimously.

    Sen. Stephenson assumed the Chair.

3.     S.B. 153 Taxes or Charges on Telecommunications Service (Bramble)

    
Sen. Bramble explained the bill.

    Bruce Johnson, Tax Commissioner spoke in support of the bill.

    Daurell Bell, Tax Dir., AT&T Wireless; Steve Young, Attorney, At&T Wireless; Robin Riggs, Quest; and David Spatafore, Utah League of Cities and Towns, spoke to the bill.

     MOTION: Sen. Bramble moved to adopt the following amendments:

     1. Page 1, Line 6:     After " amends" delete " the Utah Municipal Code,"

    2. Page 1, Lines 9:    After " changes." delete " This act prescribes the"

    3. Page 1, Lines 10-12:    Delete lines 10 through12

    4. Page 1, Line 13:    At the beginning of the line delete " facilities, or services."

    5. Page 1, Line 17:    Delete line 17

    6. Page 1, Line 27:    Delete line 27

    7. Pages 2-6, Lines 28-168:    Delete lines 28 through 168

         Renumber remaining sections accordingly.

    The motion passed with Sen. Bramble, Sen. Allen, Sen. Dmitrich and Sen. Valentine voting in favor of adopting the amendments, Sen. Stephenson voting against, and Sen. Hillyard absent for the vote.




4.     H.B. 95 Property Taxes - Notice of Delinquency (M. Dillree)

    
Rep. Dillree explained the bill.

    Larry Richardson, Salt Lake County Treasurer; Brent Gardner, Utah Association of Counties and Joel Campbell, Utah Press Association spoke in support of the bill.

     MOTION: Senator Valentine moved to pass the bill out favorably.

    The motion passed with Sen. Allen, Sen. Dmitrich and Sen. Valentine voting in favor of the bill, Sen. Stephenson voting in opposition, and Sen. Bramble and Sen. Hillyard absent for the vote.

     MOTION: Sen. Dmitrich moved to adjourn.

    The motion passed unanimously with Sen. Bramble and Sen. Hillyard absent for the vote.

    The meeting adjourned at 9:30 a.m.
