    Chair Walker called the meeting to order at 3:50 p.m.

    MOTION:
Sen. Peterson moved to approve the minutes of January 22, 2002.

    The motion passed unanimously with Sens. Knudson and Mansell absent for the vote.

1.     S.B. 61 Government Records Access and Management - Records Related to Explosives (B. Wright)

    
Sen. Wright explained the bill and distributed the following amendments:

    1. Page 1, Line 9    After "changes" insert "This act provides a coordination clause."
    2. Page 11, Line 328    After line 328 insert:
        “Section 3. Coordination Clause.
        If this bill and S.B. 93, Classification of Certain Legislative Records, both pass, it is the intent of the Legislature that the amendments in Section 63-2-304 (40) in S.B. 93 supercede the amendments to Section 63-2-304(40) in this bill.”

     MOTION: Sen. Peterson moved to adopt the amendments.

    The motion passed unanimously with Sens. Kundson and Mansell absent for the vote.

    Hal Jaussi, Manager, Ensign-Bickford, spoke in favor of the bill.

     MOTION: Sen. Peterson moved to pass the bill, as amended, with a favorable

recommendation.

    The motion passed unanimously with Sens. Kundson and Mansell absent for the vote.

2.     S.B. 79 Land Surveyor Amendments
(G. Davis)

    
Sen. Davis explained the bill.

    Robert Knox, Chairman, Utah Licensing Board, and Craig Peterson, American Council of Engineering, spoke for the bill.

     MOTION: Sen. Peterson moved to pass the bill with a favorable recommendation.

    The motion passed unanimously with Sens. Knudson and Mansell absent for the vote.

3.    S.B. 128 Open and Public Meetings Revisions
(G. Davis)

    
Sen. Davis explained the bill and distributed the following amendment:

    1. Page 2, Line 33:    After line 33 insert:
        "(5) Minutes of meetings that are required to be retained permanently shall be maintained in or converted to a format that meets long-term records storage requirements."

     MOTION: Sen. Peterson moved to adopt the amendment.

     The motion passed unanimously with Sens. Knudson and Mansell absent for the vote.

    
Alan Dayton, Deputy Mayor of Salt Lake County, spoke for the bill.

    
David Spatafore, Utah League of Cities and Towns, spoke to the bill.

     MOTION: Sen. Peterson moved to pass the bill, as amended, with a favorable recommendation.

    The motion passed with Sens. Walker, Julander, Mansell and Peterson voting in favor ,
    
and Sens. Evans, Jenkins, and Knudson voting in opposition.



3.     S.J.R. 4 Joint Resolution Allowing Changes to County Boundaries (C. Walker)



         MOTION:
Sen. Walker explained the bill and moved to amend the bill as follows:

    1. Page 1, Lines 22-23:    Delete lines 22 and 23 and insert "make a minor adjustment, as defined by statute, to the common boundary."

    The motion passed unanimously.

     MOTION: Sen. Peterson moved to amend the bill as follows:

    l. Page 1, Line 18:    After “voters”delete “living in such territory” and
        Insert “voting on the proposition

    The motion passed unanimously.

    Gary Herbert, Utah County Commissioner, spoke to the bill.

    James Smith, Draper City Manager, and Janice Auger, Mayor, Taylorsville, spoke for the bill.

     MOTION: Sen. Mansell moved to pass the bill, as amended, with a favorable recommendation.

    The motion passed unanimously.

5.     S.J.R. 3 Resolution Providing for Changing County Lines (M. Peterson)

     MOTION: Sen. Peterson moved to send S.J.R. 3 back to the Rules Committee.

    The motion passed unanimously.

    Sen. Walker resumed the chair.

6.     H.B. 20 Prohibiting Residential Lots from Crossing County Lines (D. Hogue)

    
Rep. Hogue explained the bill.

    Doug Foxley, SunCrest Development; Chris Kyler, Utah Association of Realtors, and Taz Biesinger, Utah Home Builders Association, spoke against the bill.

    Janice Augur, Mayor, Taylorsville, spoke for the bill.



    Gary Herbert, Utah County Commissioner, and James Smith, Draper City Manager, spoke to the bill.

     MOTION: Sen. Knudson moved to hold the bill.

    The motion passed unanimously.

7.     H.B. 8 Repeal of Local Government Information Technology Review Committee
    (N. Hendrickson)

    Rep. Hendrickson explained the bill.

     MOTION: Sen. Evans moved to pass the bill with a favorable recommendation.

    The motion passed unanimously with Sen. Mansell absent for the vote.

8.     H.B. 14 Repeal of State Advisory Planning Committee (P. Wallace)

     MOTION: Sen. Evans moved to pass the bill with a favorable recommendation.

    The motion passed unanimously with Sen. Mansell absent for the vote.
    
9.     S.B. 118 Distribution of Olympic Special Revenue Fund Monies
(M. Waddoups)

        Sen. Waddoups presented the bill, assisted by David Spatafore, Utah League of Cities and Towns.

        Alan Dayton, Deputy Mayor, Salt Lake County; Michael Jensen, Salt Lake County Councilman; Brent Gardner, Utah Association of Counties, and David Beck, Salt Lake County Auditor's office, spoke against the bill.

        Janice Auger, Mayor, Taylorsville, spoke for the bill.

        Rod Morelli, Executive Director, State Tax Commission, spoke to the bill.

         MOTION: Sen. Jenkins moved to pass the bill with a favorable recommendation.

        The motion passed unanimously with Sen. Mansell absent for the vote .

Sen. Jenkins moved to adjourn the meeting.

        The motion passed unanimously.

        Meeting adjourned at 5:45 p.m.
