Committee Chair Steele called the meeting to order at 9:05 a.m.

     MOTION: Sen. Eastman moved to approve the minutes of January 22, 2002.

     The motion passed unanimously with Sen. Hale and Sen. Mayne absent for the vote.

1.     H.B. 6 Public Safety Bureau Name Change (D. Bowman)     
    

    Rep. Bowman explained the bill assisted by Randy Johnson, Lt. Col., Dept. of Public Safety.
    
     MOTION: Sen. Waddoups moved to pass the bill out favorably.

    The motion passed unanimously with Sen. Mayne absent for the vote.

2.     S.B. 121 Concealed Firearm Permit Amendments (S. Jenkins)

    Sen. Jenkins explained the bill.

    Tim Osterstak, Manager, Office of the Legislative Auditor General explained the findings of an audit related to the bill.

    Sen. Jenkins proposed the following amendment:

    1.     Page 4, Line 100:    After "authority" insert ":(a) shall provide the permit holder with written or electronic information on the rights and responsibilities of carrying a concealed firearm for lawful self defense; and
                (b)
"



    Winton Clark Aposhian, Concealed Weapons Network, answered questions about the bill.

    The following people spoke in favor of the bill: Edward Endemano, citizen, Elwood Powell, Chairman, Utah Shooting Sports Council; and Charles Hardy, Gun Owners of Utah.



    Bonnie Fernandez, citizen, spoke in opposition to the bill.

     MOTION: Sen. Waddoups moved to adopt Sen. Jenkins amendment.

    The motion passed, with Sen. Hale voting in opposition.

     MOTION: Sen. Waddoups moved to move to the first bill on the agenda.

    The motion passed unanimously.

3.     S.B. 120 Motor Vehicle Insurance Coverage (M. Waddoups)

MOTION: Sen. Waddoups moved to amend the bill as follows:

    1.     Page 4, Line 104:    After line 104 insert
                "If the claimant elects to resolve the claim through binding arbitration, the election may not be rescinded without the written consent of both parties and the defendant's liability insurer."

    2.    Page 4, Line 106:    After "by" insert "a panel of"

    3.    Page 4, Lines 114-115:    Delete "all of the arbitrators" and insert "the arbitration panel"

    4.    Page 4, Line 117:    Delete "arbitrators" and insert "arbitration panel"

    5.    Page 4, Line 119:    Delete "arbitrators" and insert "arbitration panel"

    6.    Page 4, Line 120:    After "limits of all" insert "the defendant's"

    7.    Page 5, Line 121:    After "policies" insert
                "including applicable liability umbrella policies"

    8.    Page 5, Line 126:    Delete "arbitrators find" and insert "arbitration panel finds"

    9.    Page 5, Line 127:    Delete "arbitrators" and insert "arbitration panel"

    The motion passed unanimously.

     MOTION: Sen. Hickman moved to adjourn.

    The motion passed unanimously at 10:00 a.m.
