7 This joint resolution of the Legislature approves the "2002 Federal - Utah State Trust Lands
8 Consolidation Agreement" dated June 18, 2002, between the state of Utah and the United
9 States government to exchange school and institutional trust lands and mineral interests for
10 federal lands and mineral interests. The resolution provides an immediate effective date.
11 Be it resolved by the Legislature of the state of Utah:
12 WHEREAS, Section 63-34b-101 of the Utah Code requires Legislative approval before
13 a state agency may legally bind the state by executing an agreement to sell or transfer to the United
14 States government 10,000 or more acres of any state lands or school and institutional trust lands;
15 WHEREAS, School and Institutional Trust Lands Administration has agreed with the
16 United States government to exchange approximately 108,000 acres of state school and
17 institutional trust lands and mineral interests for approximately 135,000 acres of federal lands and
18 mineral interests;
19 WHEREAS, the agreement between the state of Utah and the United States government
20 entitled "2002 Federal - Utah State Trust Lands Consolidation Agreement" is dated June 18, 2002;
21 WHEREAS, the agreement would exchange school and institutional trust lands that are
22 currently scattered and, in many cases, surrounded by federal lands for consolidated lands that
23 could be more efficiently managed and administered to the benefit of trust land beneficiaries; and
24 WHEREAS, the proposed exchange is in the best interests of the citizens of Utah:
25 NOW, THEREFORE, BE IT RESOLVED that the Legislature of the state of Utah
26 approves the "2002 Federal - Utah State Trust Lands Consolidation Agreement" dated June 18,
27 2002 between the state of Utah and the United States government to exchange state school and
28 institutional trust lands and mineral interests for federal lands and mineral interests.
29 BE IT FURTHER RESOLVED that the Legislature approves an immediate effective date
30 for this resolution.
