First Substitute S.B. 5003

Senator Scott K. Jenkins proposes the following substitute bill:

             5      This act modifies the Transportation Code to amend the amount of transfers allowed from
             6      the Transportation Fund to other agencies from $10.6 million to $11.6 million. This act
             7      clarifies that revenues for the Motorcycle Rider Education Program are excluded from the
             8      transfer limitation.
             9      This act affects sections of Utah Code Annotated 1953 as follows:
             10      AMENDS:
             11          72-2-103, as renumbered and amended by Chapter 270, Laws of Utah 1998
             12      Be it enacted by the Legislature of the state of Utah:
             13          Section 1. Section 72-2-103 is amended to read:
             14           72-2-103. Limitations on Transportation Fund appropriations to agencies not a part
             15      of the Department of Transportation -- Exceptions.
             16          (1) Except as provided under [Subsections] Subsection (2) [and (3)], the amount
             17      appropriated or transferred from the Transportation Fund each year may not exceed a combined
             18      total of [$10,600,000] $11,600,000 to:
             19          (a) the Department of Public Safety;
             20          (b) the State Tax Commission;
             21          (c) the Division of Finance; and
             22          (d) any other state agency that is not a part of the Department of Transportation.
             23          (2) The following amounts are exempt from the appropriation and transfer limitations of
             24      Subsection (1):
             25          [(2) The] (a) amounts deposited in the Department of Public Safety Restricted Account


             26      created under Section 53-3-106 [are exempt from the appropriation and transfer limitations of
             27      Subsection (1).];
             28          [(3) The] (b) revenue generated by the uninsured motorist identification fee under Section
             29      41-1a-1218 [and];
             30          (c) revenue generated by the motor carrier fee under Section 41-1a-1219 or Section
             31      72-9-706 [is exempt from the appropriation and transfer limitations of Subsection (1)]; and
             32          (d) revenue generated by the Motorcycle Rider Education Program under Section
             33      53-3-905 .
