5 This act modifies the Concealed Weapons Act by increasing fees and allowing for a
6 waiver of a concealed weapons permit fee for an applicant who files an affidavit of
7 impecuniousity. The act requires the division to review its fee structure annually with the
8 intent that the cost of issuing concealed weapons permits shall be revenue neutral. The
9 act has a July 1, 2003 effective date.
10 This act affects sections of Utah Code Annotated 1953 as follows:

12 53-5-707, as last amended by Chapters 120 and 227, Laws of Utah 1999
13 Be it enacted by the Legislature of the state of Utah:
14 Section 1. Section 53-5-707 is amended to read:
15 53-5-707. Permit -- Fees -- Waivers -- Disposition.
16 (1) [
17 for a permit shall pay a fee of [
18 (b) The division shall waive the initial fee [
19 law enforcement officer under Section 53-13-103 .
20 (c) (i) The division shall waive the initial fee and renewal fee for an applicant who files
21 an affidavit of impecuniousity with the division.
22 (ii) The affidavit shall contain the same information required under Section 78-7-36
23 and be subject to review by the division.
24 (iii) The division may not waive the permit costs associated with federal background
25 checks for an applicant under Subsection (1)(c)(i).
26 (2) The renewal fee for the permit is [

31 (6) (a) The division may collect any fees charged by an outside agency for additional
32 services required by statute as a prerequisite for issuance of a permit.
33 (b) The division shall promptly forward any fees collected to the appropriate agency.
34 (7) The division shall annually review its fee structure under Subsections (1) through
35 (4) and recommend to the Legislature any changes required to make the cost of issuing permits
36 revenue neutral.
37 Section 2. Effective date.
38 This act takes effect on July 1, 2003.
