CONTROL OF WOLF POPULATION

             5      This act modifies the Wildlife Resources Code to allow wolves to be transplanted if
             6      certain conditions are met.
             7      This act affects sections of Utah Code Annotated 1953 as follows:
             8      AMENDS:
             9          23-14-21, as enacted by Chapter 154, Laws of Utah 1998
             10      Be it enacted by the Legislature of the state of Utah:
             11          Section 1. Section 23-14-21 is amended to read:
             12           23-14-21. Transplants of big game, turkeys, wolves, or sensitive species.
             13          (1) The division may transplant big game, turkeys, wolves, or sensitive species only in
             14      accordance with:
             15          (a) a list of sites for the transplant of a particular species that is prepared and adopted in
             16      accordance with Subsections (2) through (5);
             17          (b) a species management plan, such as a deer or elk management plan adopted under
             18      Section 23-16-7 or a recovery plan for a threatened or endangered species, provided that:
             19          (i) the plan identifies sites for the transplant of the species or the lands or waters the
             20      species are expected to occupy; and
             21          (ii) the public has had an opportunity to comment and make recommendations on the
             22      plan; [or]
             23          (c) a legal agreement between the state and a tribal government that identifies potential
             24      transplants[.]; or
             25          (d) the Endangered Species Act of 1973, 16 U.S.C. Sec. 1531 et seq.
             26          (2) The division shall:
             27          (a) consult with the landowner in determining the suitability of a site for the transplant



             28      of a species;
             29          (b) prepare a list of proposed sites for the transplant of species;
             30          (c) provide notification of proposed sites for the transplant of species to:
             31          (i) local government officials having jurisdiction over areas that may be affected by a
             32      transplant; and
             33          (ii) the Resource Development Coordinating Committee created in Section 63-28a-2 .
             34          (3) After receiving comments from local government officials and the Resource
             35      Development Coordinating Committee, the division shall submit the list of proposed transplant
             36      sites, or a revised list, to regional advisory councils for regions that may be affected by the
             37      transplants of species.
             38          (4) Each regional advisory council reviewing a list of proposed sites for the transplant
             39      of species may submit recommendations to the Wildlife Board.
             40          (5) The Wildlife Board shall approve, modify, or reject each proposal for the transplant
             41      of a species.
             42          (6) Each list of proposed transplant sites approved by the Wildlife Board shall have a
             43      termination date after which a transplant may not occur.
