5 This act modifies the State System of Public Education by appropriating an additional
6 $80,000,000 for the fiscal year beginning July 1, 2003 and as an ongoing appropriation, to
7 the State Board of Education for the Interventions for Student Success Block Grant
8 Program. This act takes effect on July 1, 2003.
9 This act affects sections of Utah Code Annotated 1953 as follows:
10 AMENDS:
11 53A-17a-123.5, as enacted by Chapter 279, Laws of Utah 2002
12 Be it enacted by the Legislature of the state of Utah:
13 Section 1. Section 53A-17a-123.5 is amended to read:
14 53A-17a-123.5. Interventions for Student Success Block Grant Program -- State
15 contribution.
16 (1) (a) There is appropriated to the State Board of Education for the fiscal year
17 beginning July 1, 2002, $15,553,062 for the Interventions for Student Success Block Grant
18 Program.
19 (b) In addition to the money appropriated in Subsection (1)(a), subject to future budget
20 constraints, there is appropriated, as an ongoing appropriation, to the State Board of Education
21 for the fiscal year beginning July 1, 2003, $80,000,000 for the Interventions for Student
22 Success Block Grant Program.
23 (2) The State Board of Education shall distribute the money appropriated in Subsection
24 (1) to school districts and charter schools according to a formula adopted by the board, after
25 consultation with school districts and charter schools, that allocates the funding in a fair and
26 equitable manner.
27 (3) Schools districts and charter schools shall use Interventions for Student Success
28 Block Grant monies to improve student academic success, with priority given to interventions
29 on behalf of students not performing to standards as determined by U-PASS test results.
30 (4) (a) Each school district shall develop a plan for the expenditure of Interventions for
31 Student Success Block Grant monies.
32 (b) The plan:
33 (i) shall specify anticipated results; and
34 (ii) may include continuing existing programs to improve students' academic success
35 for which funds were appropriated before the establishment of the block grant.
36 (c) The local school board shall approve the plan for the expenditure of the block grant
37 monies in an open public meeting before the monies are spent.
38 Section 2. Effective date.
39 This act takes effect on July 1, 2003.
