BICYCLE FACILITY STANDARDS

             5      This act modifies the Motor Vehicles Code by requiring the Department of
             6      Transportation to adopt by rule, standards for the development of bicycle facilities by the
             7      Department of Transportation and local authorities. This act clarifies that traffic control
             8      device standards adopted by the Department of Transportation are applicable on all
             9      highways in the state. This act makes technical changes.
             10      This act affects sections of Utah Code Annotated 1953 as follows:
             11      AMENDS:
             12          41-6-20, as last amended by Chapter 38, Laws of Utah 2002
             13          41-6-22, as last amended by Chapter 138, Laws of Utah 1987
             14      Be it enacted by the Legislature of the state of Utah:
             15          Section 1. Section 41-6-20 is amended to read:
             16           41-6-20. Manual and specifications for uniform system of traffic-control devices,
             17      school crossing guards, and bicycle facilities -- Applicable to all highways.
             18          (1) As used in this section, "bicycle facility" means any improvement or provision on a
             19      public right-of-way made to accommodate or encourage bicycling including:
             20          (a) a bicycle lane;
             21          (b) a bicycle path;
             22          (c) a bicycle route system; or
             23          (d) a bikeway.
             24          [(1) (a)] (2) In accordance with Title 63, Chapter 46a, Utah Administrative Rulemaking
             25      Act, the Department of Transportation shall make rules:
             26          (a) consistent with this chapter adopting a manual and establishing specifications for a
             27      uniform system of traffic-control devices [for use upon highways within this state.] used on a



             28      highway;
             29          (b) adopting a manual and establishing specifications for a uniform system of
             30      traffic-control devices and school crossing guards for school crossing zones, which shall
             31      supplement the manual adopted under Subsection (2)(a); and
             32          (c) adopting the AASHTO (American Association of State Highway and
             33      Transportation Officials) Guide for the Development of Bicycle Facilities which is a
             34      supplement to the AASHTO Policy on Geometric Design of Highways and Streets.
             35          [(b)] (3) The manual adopted under Subsection (2)(a) shall correlate with, and where
             36      possible conform to, the system set forth in the most recent edition of the "Manual on Uniform
             37      Traffic Control Devices for Streets and Highways" and other standards issued or endorsed by
             38      the federal highway administrator.
             39          [(2) In accordance with Title 63, Chapter 46a, Utah Administrative Rulemaking Act,
             40      the Department of Transportation shall make rules adopting a manual and establishing
             41      specifications for a uniform system of traffic-control devices and school crossing guards for
             42      school crossing zones, which shall supplement the manual adopted under Subsection (1).]
             43          (4) The standards adopted by rule under this section are applicable on all highways
             44      including bicycle facilities throughout the state.
             45          Section 2. Section 41-6-22 is amended to read:
             46           41-6-22. Placing and maintenance upon local highways by a local authority.
             47          (1) [Local authorities, in their respective jurisdictions,] A local authority shall place
             48      and maintain official traffic-control devices upon highways under their jurisdiction as they find
             49      necessary to indicate and to carry out the provisions of this chapter or local traffic ordinances,
             50      or to regulate, warn, or guide traffic.
             51          (2) All traffic-control devices erected under this section shall conform to and be
             52      maintained in conformance with the [Department of Transportation manual and specifications
             53      for a uniform system of traffic-control devices] standards adopted under Section 41-6-20 .
