First Substitute H.B. 325

Representative Glenn A. Donnelson proposes the following substitute bill:

1 COURT-ORDERED COUNSELING
2 2003 GENERAL SESSION
3 STATE OF UTAH
4 Sponsor: Glenn A. Donnelson
5 This act modifies the Juvenile Court Act, providing that a person ordered to obtain
6 counseling by the court may be counseled by a member of the clergy.
7 This act affects sections of Utah Code Annotated 1953 as follows:
8 ENACTS:
9 78-3a-122, Utah Code Annotated 1953
10 Be it enacted by the Legislature of the state of Utah:
11 Section 1. Section 78-3a-122 is enacted to read:
12 78-3a-122. Court-ordered counseling.
13 If a person is ordered by the court to participate in counseling as part of a program or
14 treatment plan, the person may be allowed to be counseled by a member of the clergy upon the
15 request of the person and with the approval of the judge, and subject to reporting requirements
16 prescribed within the program or treatment plan as prescribed by the judge and agreed to by the
17 member of the clergy.
