5 This act funds appropriations and reductions for the support of state government for the fiscal years beginning
6 July 1, 2003 and ending June 30, 2004 and beginning July 1, 2002 and ending June 30, 2003. This act provides
7 budget increases and decreases for the use and support of certain state departments and agencies of state
8 government. The act provides appropriate funds for the bills with fiscal impact passed in the 2003 General
9 Session and for other purposes as provided in this act. The act provides intent language governing expenditures
10 and approves fees. This act provides an effective date.
11 Be it enacted by the Legislature of the State of Utah:
12 Section 1. Under the terms and conditions of Section 63-38-3, the following sums of money are appropriated out of money
13 not otherwise appropriated, or reduced out of money previously appropriated, from the funds or fund accounts indicated for
14 the use and support of certain State departments and agencies for the fiscal year beginning July 1, 2003 and ending June 30,
15 2004. This is an addition to or a subtraction from amounts appropriated by House Bill 1, 2003 General Session.

170 It is the intent of the Legislature that the Division of Facilities
171 Construction and Management sell the state's interest in the Iron County
172 Correction Facility to Iron County for $2,000,000 according to the terms
173 specified below identified as (a), (b), (c), and (d).
174 (a) Iron County will pay the state $1,550,000 in cash.
175 (b) To pay the $450,000 balance of the purchase price, Iron County will:
176 (i) provide office space for the Department of Corrections' Adult
177 Probation and Parole in the Iron County Correction Facility for ten years at
178 no cost to the state of Utah, at an estimated value of $45,000 per year for a
179 total ten year value of $450,000; and
180 (ii) contract with the Department of Corrections to house 15 state
181 prisoners in the Iron County Correctional Facility for at least five years.
182 (c) (i) The Department of Corrections shall select the 15 prisoners to house at
183 the Iron County Correctional Facility from beds currently under contract in
184 other counties.
185 (ii) Nothing in this section may be construed to authorize or require the
186 Department of Corrections to increase the number of prisoners currently
187 housed in county correctional facilities on state contract.
188 (d) If the Department of Corrections' Adult Probation and Parole chooses, for
189 whatever reason, not to use the office space offered by Iron County, Iron
190 County is not liable for, and need not pay, the state the value of that
191 estimated rent.

198 It is the intent of the Legislature that Information Technology Services be
199 allowed to add FTEs beyond the authorized level if it represents a benefit to
200 the state and a decrease of FTEs in the user agency. The total FTEs within
201 state government shall not change with this shift of FTEs. Prior to
202 transferring FTEs to the Internal Service Fund, the Department of
203 Administrative Services shall report to the Executive Appropriations
204 Committee decreased personal service expenditures in the originating agency
205 and corresponding increased Internal Service Fund charges that will result from
206 the transfer.
