             5      This act modifies the Motor Vehicles Code by increasing vehicle registration fees. This
             6      act increases the duplicate registration certificate fee and an original or duplicate title fee.
             7      This act provides that the increased fees are deposited in the Centennial Highway Fund.
             8      This act takes effect on July 1, 2003.
             9      This act affects sections of Utah Code Annotated 1953 as follows:
             10      AMENDS:
             11          41-1a-1201, as last amended by Chapter 1, Laws of Utah 2003
             12          41-1a-1206, as last amended by Chapter 244, Laws of Utah 2000
             13          41-1a-1208, as repealed and reenacted by Chapter 222, Laws of Utah 1993
             14          41-1a-1210, as repealed and reenacted by Chapter 222, Laws of Utah 1993
             15          72-2-118, as last amended by Chapter 147, Laws of Utah 2000
             16      Be it enacted by the Legislature of the state of Utah:
             17          Section 1. Section 41-1a-1201 is amended to read:
             18           41-1a-1201. Disposition of fees.
             19          (1) All fees received and collected under this part shall be transmitted daily to the state
             20      treasurer.
             21          (2) Except as provided in Subsections (3), (4), [and] (6), and (7), and Section
             22      41-1a-422 , and in Section 41-1a-1220 , all fees collected under this part shall be deposited in
             23      the Transportation Fund.
             24          (3) (a) Funds generated under Subsections 41-1a-1211 (1)(a), (6)(a), and (7) and
             25      Section 41-1a-1212 may be used by the commission as a dedicated credit to cover the costs
             26      incurred in issuing license plates under Part 4, License Plates and Registration Indicia.
             27          (b) Fees for statehood centennial license plates shall be collected and deposited in the

     Transportation Fund, less production and administrative costs incurred by the commission.
             29          (4) All funds available to the commission for purchase and distribution of license
             30      plates and decals are nonlapsing.
             31          (5) Except as provided in Subsection (3) and Section 41-1a-1205 , the expenses of the
             32      commission in enforcing and administering this part shall be provided for by legislative
             33      appropriation from the revenues of the Transportation Fund.
             34          (6) The following portions of the registration fees imposed under Section 41-1a-1206
             35      for each vehicle shall be deposited in the Centennial Highway Fund created under Section
             36      72-2-118 :
             37          (a) $10 of the registration fees imposed under Subsections 41-1a-1206 (1)(a), [(1)(b),]
             38      (2), and (5);
             39          (b) $1 of the registration fees imposed under Subsections 41-1a-1206 (1)(c)(i),
             40      (1)(c)(ii), and (1)(d)(ii);
             41          (c) $2 of the registration fee imposed under Subsection 41-1a-1206 (1)(e)(ii);
             42          (d) $3 of the registration fee imposed under Subsection 41-1a-1206 (1)(d)(i); and
             43          (e) $4.50 of the registration fee imposed under Subsection 41-1a-1206 (1)(e)(i)[.]; and
             44          (f) S [ $1 ] $11 s of the registration fee imposed under Subsection 41-1a-1206 (1)(b).
             45          (7) The following portions of each fee imposed shall be deposited in the Centennial
             46      Highway Fund created under Section 72-2-118 :
             47          (a) $1 of the duplicate certificate of registration fee imposed under Section 41-1a-1208 ;
             48      and
             49          (b) $1 of the original or duplicate certificate of title fee imposed under Section
             50      41-1a-1210 .
             51          Section 2. Section 41-1a-1206 is amended to read:
             52           41-1a-1206. Registration fees -- Fees by gross laden weight.
             53          (1) Except as provided in Subsection (2), at the time application is made for
             54      registration or renewal of registration of a vehicle or combination of vehicles under this
             55      chapter, a registration fee shall be paid to the division as follows:
             56          (a) $22.50 for each motorcycle;
             57          (b) [$21] $22 for each motor vehicle of 12,000 pounds or less gross laden weight,
             58      excluding motorcycles;

         (c) unless the semitrailer or trailer is exempt from registration under Section 41-1a-202
             60      or is registered under Section 41-1a-301 :
             61          (i) $11 for each trailer or semitrailer over 750 pounds gross unladen weight; or
             62          (ii) $8.50 for each commercial trailer or commercial semitrailer of 750 pounds or less
             63      gross unladen weight;
             64          (d) (i) $33 for each farm truck over 12,000 pounds, but not exceeding 14,000 pounds
             65      gross laden weight; plus
             66          (ii) $9 for each 2,000 pounds over 14,000 pounds gross laden weight; and
             67          (e) (i) $49.50 for each motor vehicle or combination of motor vehicles, excluding farm
             68      trucks, over 12,000 pounds, but not exceeding 14,000 pounds gross laden weight; plus
             69          (ii) $18.50 for each 2,000 pounds over 14,000 pounds gross laden weight.
             70          (2) The initial registration fee for a vintage vehicle is $20.
             71          (3) If a motor vehicle is operated in combination with a semitrailer or trailer, each
             72      motor vehicle shall register for the total gross laden weight of all units of the combination if the
             73      total gross laden weight of the combination exceeds 12,000 pounds.
             74          (4) (a) Registration fee categories under this section are based on the gross laden
             75      weight declared in the licensee's application for registration.
             76          (b) Gross laden weight shall be computed in units of 2,000 pounds. A fractional part
             77      of 2,000 pounds is a full unit.
             78          (5) The owner of a commercial trailer or commercial semitrailer may, as an alternative
             79      to registering under Subsection (1)(c), apply for and obtain a special lifetime registration and
             80      license plate for a fee of $110.
             81          (6) Except as provided in Section 41-6-163.6 , a truck may not be registered as a farm
             82      truck unless:
             83          (a) the truck meets the definition of a farm truck under Section 41-1a-102 ; and
             84          (b) (i) the truck has a gross vehicle weight rating of more than 12,000 pounds; or
             85          (ii) the truck has a gross vehicle weight rating of 12,000 pounds or less and the owner
             86      submits to the division a certificate of emissions inspection or a waiver in compliance with
             87      Section 41-6-163.6 .
             88          (7) A violation of Subsection (6) is a class B misdemeanor that shall be punished by a
             89      fine of not less than $200.

         (8) Trucks used exclusively to pump cement, bore wells, or perform crane services
             91      with a crane lift capacity of five or more tons, are exempt from 50% of the amount of the fees
             92      required for those vehicles under this section.
             93          Section 3. Section 41-1a-1208 is amended to read:
             94           41-1a-1208. Fees for duplicate certificates of registration.
             95          A duplicate certificate of registration may be issued upon application and payment of
             96      [$4] $5 to the division.
             97          Section 4. Section 41-1a-1210 is amended to read:
             98           41-1a-1210. Fees for original and duplicate certificates of title.
             99          A fee of [$6] $7 shall be paid to the division for the issuance of each original and
             100      duplicate certificate of title for a vehicle, vessel, or outboard motor.
             101          Section 5. Section 72-2-118 is amended to read:
             102           72-2-118. Centennial Highway Fund.
             103          (1) There is created a special revenue fund entitled the Centennial Highway Fund.
             104          (2) The fund consists of monies generated from the following revenue sources:
             105          (a) any voluntary contributions received for the construction, major reconstruction, or
             106      major renovation of state or federal highways;
             107          (b) appropriations made to the fund by the Legislature;
             108          (c) registration and title fees designated under [Subsection] Subsections 41-1a-1201 (6)
             109      and (7); and
             110          (d) the sales and use tax amounts provided for in Section 59-12-103 .
             111          (3) (a) The fund shall earn interest.
             112          (b) All interest earned on fund monies shall be deposited into the fund.
             113          (4) The executive director may use fund monies, as prioritized by the Transportation
             114      Commission, only to pay the costs of construction, major reconstruction, or major renovation
             115      to state and federal highways.
             116          Section 6. Effective date.
             117          This act takes effect on July 1, 2003.
