6 This act modifies the Utah Emergency Medical Services System Act. The act establishes a
7 statewide database for the collection and distribution of information regarding the
8 location of commercially owned fully automated external defibrillators. The act
9 authorizes the department to work with community agencies to promote education and
10 instruction on the use of fully automated external defibrillators and cardio pulmonary
11 resuscitation.
12 This act affects sections of Utah Code Annotated 1953 as follows:
13 ENACTS:

15 Be it enacted by the Legislature of the state of Utah:
16 Section 1. Section 26-8a-209 is enacted to read:
17 26-8a-209. Fully automated external defibrillator statewide database.
18 (1) The department shall work in cooperation with state, federal, and local agencies to
19 encourage individuals to complete a course that includes instruction on cardiopulmonary
20 resuscitation and the operation and use of a fully automated external defibrillator that is
21 conducted in accordance with guidelines of the American Heart Association, American Red
22 Cross, or other nationally recognized program by a person qualified by training or experience.
23 (2) The department shall establish and maintain a statewide database containing the
24 following information:
25 (a) the name of the owner of a fully automated external defibrillator; and
26 (b) the precise location of the fully automated external defibrillator, including the
27 address and the place in which the defibrillator is stored.
28 (3) (a) The department shall give the information from the database to emergency
29 medical service dispatch centers in the state.
30 (b) Emergency medical dispatch centers in the state may disclose the nearest location
31 of a fully automated external defibrillator to a person calling the dispatch center in the event of
32 a medical emergency and to first responders in an emergency.
33 (4) (a) Manufacturers selling fully automated external defibrillators in the state shall:
34 (i) inform commercial purchasers in writing of the requirement to register the
35 ownership and location of the fully automated external defibrillator with the department;
36 (ii) provide to the purchaser of a fully automated external defibrillator all information
37 governing the use, installation, operation, training, and maintenance of the fully automated
38 external defibrillator; and
39 (iii) on a quarterly basis, notify the department of the name and address of a
40 commercial purchaser of a fully automated external defibrillator and the type of device
41 purchased.
42 (b) (i) A commercial owner of a fully automated external defibrillator shall register the
43 ownership and precise location of the defibrillator with the department within 30 days of
44 acquisition of the defibrillator.
45 (ii) An owner of a fully automated external defibrillator purchased for use in a private
46 residence may register the ownership and precise location of the defibrillator with the
47 department.
48 (c) The department may not impose penalties on a manufacturer or an owner of a fully
49 automated external defibrillator for failing to comply with the requirements of this section.
