Rep. Bryson called the meeting to order at 8:15 a.m.

Rep Bryson called for an introduction of committee members.

H.B. 4        Viatical Settlements (B. Parker)

Rep. Parker introduced the bill

Spoke for the bill:    Paul Rogers, Coventry First
            George Robison, Utah Dept. of Commerce, Securities Division

MOTION:    Rep. Hansen moved to pass the bill out favorably. The motion passed unanimously.

Rep. Bryson called for a 5 minute saunter

Rep. Bryson relinquished the chair to Rep. Parker.


H.B. 12    Utah Optometry Practice Act Amendments (K. Bryson)

MOTION:    Rep. Bryson moved to amend the bill as follows:

1.    Page 1, line 7:    After "act" delete "allows"

2.    Page 1, lines 8-9:    Delete lines 8 and 9

3.    Page 1, line 10:    Delete "patient at the time of the examination" and insert "conforms state law to federal regulations on standards for privacy of individually identifiable health information"

4    Page 4, line 106:    after "fitting" delete "unless:" and insert "; and"

5.     Page 4, lines 107-110:    Delete lines 107 - 110

6.    Page 4, line 114:    After line 114 insert
        "(3) Application of the provisions of this section shall be consistent with 45 CFR Parts 160 and 164, Standards for Privacy of Individually Identifiable Health Information."

The motion passed unanimously with Rep. Buttars absent for the vote.

Rep. Bryson presented the bill as amended with the assistance of Jay J. Magure of 1-800- CONTACTS.

MOTION:    Rep. S. Clark moved to adjourn the meeting. The motion failed with Rep. Ferry and Rep. S. Clark voting in favor of the motion and Rep. Morley absent for the vote.



SUBSTITUTE
MOTION:    Rep. Dunnigan moved to amend the bill. After committee discussion, the motion was withdrawn

        The original motion to pass the bill out favorably passed with Rep. Ferry voting in opposition and Rep. Morley absent for the vote.

MOTION:    Rep. David Clark moved to adjourn the meeting. The motion passed unanimously with Rep. Morley absent for the vote.

Rep. Parker adjourned the meeting at 10:00 a.m.
