Chair Bryson called the meeting to order at 8:08 a.m.

MOTION:    Rep. Biskupski moved to approve the minutes of the January 27, 2003 meeting. The motion passed unanimously, with Rep. S. Clark, and Rep. Morley absent for the vote.

1st Sub. S.B. 88    Security Personnel Licensing Act Amendments (D. Eastman)

Sen. Eastman introduced the bill assisted by:
        Robert Anderton, Professional Association of Contract Security Companies
        Craig Jackson, Director, DOPL
        Ray Walker, Regulation and Compliance Officer, DOPL

MOTION:    Rep. Hansen moved to pass the bill out favorably. The motion passed unanimously, with Rep. S. Clark, and Rep. Morley absent for the vote.

S.B. 94    Certified Public Accountant Licensing Act Amendments (J. Valentine)


Sen. Valentine introduced the bill.

MOTION:    Rep. Dunnigan moved to pass the bill out favorably. The motion passed unanimously, with Rep. Hansen absent for the vote.

H.B. 48    Utah Construction Trade Licensing Act Amendments (S. Urquhart)

MOTION:    Rep. D. Clark moved to delete in title and body H.B. 48 and replace it with 1st Sub. H.B. 48. The motion passed unanimously, with Rep. Hansen absent for the vote.

Rep. Urquhart introduced the bill with the assistance of:

MOTION:    Rep. Morley moved to amend the bill as follows:

    Page 4, Line 109:            Delete “city, town or other municipal corporation” and insert “compliance agency as defined in Section 58-56-3(4)

MOTION:    Rep. D. Clark moved to pass the bill out favorably. The motion passed with Rep. Biskuspski, Rep. Dunnigan, Rep. Hansen, Rep. Morley, Rep. Parker, and Rep. Bryson voting in opposition.

H.B. 90    Equipment Dealer Warranty Reimbursement Act (D. Peterson)

Rep. Peterson introduced the bill with the assistance of Paul McPherson, Farr West Dealer Association.

MOTION:    Rep. D. Clark moved to amend the bill as follows:

1.    Page 3, Line 69:    After "(a)" insert "(i)"

2.    Page 3, Line 70:    Delete "(i)" and insert "(A)"

3.    Page 3, Line 72:    After "hour;" delete "and"

4.    Page 3, Line 73:    Delete "(ii)" and insert "(B)" and after "parts" delete ", the 20%"

5.    Page 3, Line 74:    After "behalf " delete "," and insert "; and"

6.    Page 3, Line 75:    Delete "plus" and insert "(C) extraordinary" and after line 75 insert:
        "(ii) For purposes of Subsection (4)(a)(i)(C), "extraordinary freight and handling costs" mean costs that are above and beyond the normal reimbursement policy of the supplier for warranty repair work."


        The motion passed unanimously.

MOTION:    Rep. Buttars moved to amend the bill as follows:

1.    Page 2, Line 49:    After line 49 insert:
        "(c) "Supplier" does not include an independent wholesaler of the items listed in Subsections (4)(a) through (f), who:
        (i) does not manufacture any significant part of the items; and
        (ii) is not owned in any part by the manufacturer."

        The motion passed unanimously.         

MOTION: Rep. S. Clark moved to pass the bill out favorably. The motion passed unanimously.

S.B. 83    Occupational and Professional Licensing Modifications (L. Hillyard)

Sen. Hillyard introduced the bill with the assistance of Ray Walker, Regulation and Compliance Officer, DOPL.

MOTION:    Rep. Biskupski moved to pass the bill out favorably. The motion passed unanimously.

Rep. D. Clark declared a conflict of interest.

MOTION:    Rep. Ferry moved to adjourn the meeting. The motion passed unanimously.
