Vice Chair Mascaro called the meeting to order at 2:12 p.m.
MOTION: Representative Bird moved to approve the minutes of the committee meetings of January 21 and 22, 2003. The motion passed unanimously with Representative Dillree and Representative Lockhart absent for the vote.
H.B. 34 Amendments to Child Welfare Legislative Oversight Panel and Open and Public Meetings (M. Morley)
Representative Morley presented the bill to the committee with a proposed substitute.
MOTION: Representative Bird moved that 1st Substitute H.B. 34 replace H.B. 34. The motion passed unanimously with Representative Dillree and Representative Lockhart absent for the vote.
Consideration of the bill, which was introduced in the meeting of January 21st, continued with Representative Morley explaining the bill to the committee
MOTION: Representative Thompson moved to pass the substitute bill out favorably. The motion passed unanimously with Representative Dillree and Representative Lockhart absent for the vote.
H.B. 176 Termination of Parental Rights (M. Thompson)
Representative Thompson explained the bill to the committee.
MOTION: Representative Buffmire moved to pass the bill out favorably. The motion passed unanimously.
H.B. 5 Prohibition of Coercive Restraint Therapy (M. Thompson)
Prior to discussion of the bill, those who would testify before the committee on H.B. 5 were sworn in by committee staff.
Representative Thompson presented the bill to the committee with a proposed substitute.
MOTION: Representative Jones moved that 1st Substitute H.B. 5 replace H.B. 5. The motion passed unanimously.
Representative Thompson explained the substitute bill to the committee and distributed handouts. Assisting him in the presentation were Dr. R. Christopher Barden, Licensed Psychologist, and Ms. Susan Middleton, President - Utah Chapter, National Association of Social Workers.
Ms. Mary Noonan, Child Protection Division, Attorney General's Office; Ms. Mary Lou Dixon; Dr. Nan Klein, Utah Psychological Association; Mr. Larry Sarner, Advocate for Children in Therapy; Ms. Sandra Lucas, Citizens Commission on Human Rights; and Kym Meyer, Executive Director - National Association of Social Workers, Utah; spoke in support of the bill.
Speaking in opposition to the bill were Ms. Engracia Dougherty, Ms. Carol Cadina, Ms. Laura Thabin, Hope for Children, Ms. Charly Risenmay, SAFFCare (Safe Adoptive Families for Children at Risk Emotionally), and Representative James A. Ferrin.
MOTION: Representative Buffmire moved to pass the substitute bill out favorably. The motion passed unanimously.
MOTION: Representative Buffmire moved to adjourn the meeting. The motion passed unanimously.
Vice Chair Mascaro adjourned the meeting at 3:35 p.m.
