Vice Chair Mascaro called the meeting to order at 7:13 a.m.

MOTION:    Representative Lockhart moved to approve the minutes of the February 13, 2003 committee meeting. The motion passed unanimously with Representative Thompson absent for the vote.


H.B. 123    Prohibition of Public Funding for Abortion (J. M. Philpot)

Representative Philpot presented the bill to the committee with proposed amendments.

MOTION:    Representative Lockhart moved to amend the bill as follows:

1.    Page 1, Line 17:    Delete "Subsection" and insert "Subsections"

2.    Page 1, Line 18:    After "(a)" insert ",(b), or (c)"

3. Page 1, Line 19    Delete "shall" and insert "may"
        Delete "all" and insert "any or all of"


4.     Page 1, Line 20:    After Line 20, insert:
            "(3) Any agent of a state agency or political subdivision, acting alone or in concert with others who authorize the use of funds prohibited in Subsection (1) is guilty of a class B misdemeanor and shall be terminated from employment.

    The motion passed unanimously.

Representative Philpot explained the bill to the committee.

Mr. Doug Springmeyer, Assistant Attorney General, Department of Health, spoke to the bill.

Speaking in support of the bill were Ms. Maryann Christensen, Activist - Download Group; and Ms. Gayle Ruzicka, Utah Eagle Forum.

Ms. Karrie Galloway, CEO - Planned Parenthood, spoke in opposition to the bill.

MOTION:    Representative Lockhart moved to pass the bill out favorably as amended.

        SUBSTITUTE MOTION: Representative Buffmire made a motion that the committee move on to the next agenda item. The motion failed with Representative Buffmire, Representative Jones, and Representative Litvack voting yes.

    Voting then took place on the original motion of Representative Lockhart to pass the bill out favorably as amended. The motion passed with Representative Buffmire, Representative Jones, and Representative Litvack voting no.


H.B. 241    Partial Birth Abortion Amendments (M. Thompson)

Representative Thompson explained the bill to the committee.

Speaking in support of the bill were Ms. Gayle Ruzicka, Utah Eagle Forum; Mr. Blaine Hunsaker, Utah Eagle Forum; and Ms. Maryann Christensen, Activist - Download Group.

Ms. Karrie Galloway, CEO Planned Parenthood; Dr. Cindy Jones, Obstetrician/Gynecologist - Utah Medical Association; and Dr. Jennifer Van Horn, University of Utah, spoke in opposition to the bill.



MOTION:    Representative Lockhart moved to pass the bill out favorably. The motion passed with Representative Buffmire and Representative Litvack voting no.


MOTION:    Representative Buxton moved to adjourn the meeting. The motion passed unanimously.

Vice Chair Mascaro adjourned the meeting at 9:14 a.m.
