    Representative Ferry called the meeting to order at 8:05 a.m., and called for a motion to approve the minutes of January 30, 2003.

MOTION:    Representative Bennion moved to approve the minutes of January 30, 2003. The motion passed unanimously with Representatives Bryson, Curtis, Hendrickson, Hutchings, and Thompson absent for the vote.

H.B. 159    Voluntary Contribution Act Amendments     (C. Bennion)

    The sponsor introduced the bill to the committee.

    Speaking in favor of the bill was Ron Casper, Capital Strategies Group.

    Speaking in opposition to the bill was Michael McCoy, Utah Education Association, General Counsel, Pat Rusk, President, Utah Education Association, Phil Dyer, Utah Public Employees Association, General Counsel, and Geoff Leonard, Utah School Employees Association.


MOTION:    Representative Daniels moved that Mr. Dyer not read item 4 from his printed statement. The motion passed unanimously.

MOTION:    Representative McGee moved to table the bill.

:    Representative Bennion moved to pass the bill out favorably. The motion passed 7-6 with Representatives Bennion, Curtis, Hutchings, Love, Philpot, Adams, and Ferry voting in favor of the motion, and Representatives Bryson, Daniels, Hendrickson, Lawrence, McGee, and Thompson voting against the motion.

H.B. 88    Payment of Reward upon Arrest and Conviction, was not discussed at the sponsors request.

H.B. 93    Suspension of Driving Privileges for Habitual Truants     (D. Bourdeaux)

MOTION:    Representative Love moved to amend:

1.     Page 1, Line 8:    At the beginning of the line delete “suspended for a year or

3.     Page 7, Line 210:    Delete “privilege suspended for up to one year by the court.


    The motion failed on a tie vote, with Representatives Bennion, Bryson, Lawrence, Love, Adams, and Ferry voting in favor of the motion, and Representatives Daniels, Hendrickson, Hutchings, McGee, Philpot, and Thompson voting against the motion to amend.

    Speaking to the bill was Rick Schwermer, Administrative Office of the Courts, Bart Blackstock, Deputy Director, Drivers License Division. Speaking in favor of the bill was Ralph Hawes, School Board Association, and Pat Rusk, President, Utah Education Association.

MOTION:    Representative Philpot moved to table the bill.

SUBSTITUTE
MOTION:
    Representative McGee moved to pass the bill out favorably as amended. The substitute motion failed on a 4-7 vote, with Representatives Daniels, Hendrickson, Hutchings, and McGee voting in favor of the motion, and Representatives, Bennion, Bryson, Lawrence, Love, Philpot, Thompson, Adams, and Ferry voting against the motion, and Representative Curtis absent for the vote.

MOTION:    Representative Thompson moved to adjourn. The motion passed with Representative McGee voting in opposition to the motion, and Representative Curtis absent for the vote. The meeting adjourned at 10:07 a.m.
