Chair Holdaway called the meeting to order at 3:55 p.m.

Motion:    Rep. Dee moved to approve the minutes of January 28, 2003. The motion passed unanimously with a vote of 6-0-4, with Reps. Barrus, Bourdeaux, Duckworth and Murray absent for the vote.


H.B. 54    Special Districts and Local Districts - Acquisition of Real Property (G. Hughes)

H.B. 54 was not considered.


H.B. 98    Municipal Disconnection Amendments (A. Hardy)

Rep. Hardy introduced the bill.

David Church, Utah League of Cities and Towns, further explained the bill.

Kara Trevino, Salt Lake County Mayor's Office, spoke to the bill.

Motion:    Rep. Dee moved that the committee report a favorable recommendation on H.B. 98. The motion passed unanimously with a vote of 9-0-1, with Rep. Barrus absent for the vote.




H.B. 95    Annexation of Unincorporated County Islands into Cities (T. Kiser)

Motion:    Rep. Buxton moved to adopt the following amendments:

1.    Page 2, Line 31:    After "under" reinstate "this section" and delete "Subsection (1)(a)(i)"

2.    Page 3, Line 87:    After "(b) covers" insert ":
        (i) for a proposed annexation under Subsection (1)(a)(i),
"

3.    Page 3, Line 88:    After "annexation;" bracket "and" and insert "or
        (ii) for a proposed annexation under Subsection (1)(a)(ii), 10% of the total private land area within the island of unincorporated area that is proposed for annexation; and
"

4.    Page 3, Line 89:    After "at least" insert ":
        (i) for a proposed annexation under Subsection (1)(a)(i),
"

5.     Page 4, Line 90:    After "annexation" insert "; or
        (ii) for a proposed annexation under Subsection (1)(a)(ii), 10% of the value of all private real property within the island of unincorporated area that is proposed for annexation
"

6.    Page 4, Line 91:    After "(4)" insert "(a)"

7.    Page 4, Line 93:    After line 93 insert:

        "(b) Subsection (4)(a) may not be construed to prohibit the municipal legislative body from excluding from a proposed annexation under Subsection (1)(a)(ii) the property within an unincorporated island regarding which protests have been filed and proceeding under Subsection (1)(b) to annex some or all of the remaining portion of the unincorporated island."

The motion to amend passed unanimously with a vote of 10-0-0.

Rep. Kiser introduced the bill as amended.

Motion:    Rep. Hogue moved that the committee report a favorable recommendation on H.B. 95 as amended. The motion passed unanimously with a vote of 10-0-0.


H.B. 97    Repeal of Sunset Date for Limitations on Annexing Township (E. Hutchings)

H.B. 97 was not considered.


S.B. 35    Redevelopment of Superfund Sites (D. C. Buttars)

S.B. 35 was not considered.


Motion:    Rep. Hogue moved to adjourn. The motion passed unanimously and the meeting adjourned at 4:36 p.m.
