Chair Harper called the meeting to order at 8:10 a.m.

MOTION:    Rep. Buffmire moved to approve the minutes of February 20, 2003. The motion passed unanimously with Rep. Anderson, Rep. Philpot and Rep. Winn absent for the vote.

H.B.300    Tax of Sexually Explicit Materials (D. Bourdeaux)

MOTION:    Rep. Buffmire moved to amend the bill as follows:

1.    Page 3, Line 83:    After line 83 insert:
        "(4) The commission shall administer this chapter in accordance with Chapter 12, Part 1, Tax Collection."

     The motion passed unanimously with Rep. Philpot and Rep. Winn absent for the v ote.

Rep. Bourdeaux introduced the bill and explained it to the committee with the assistance of Ms. Kathy Ookey, FCCC Director, UDC and Mr. Larry Fox, Clinical Director, Carter Family Development. Rep. Bourdeax declared a potential conflict of interest.

Mr. Dave Fowers, Co-Chairman, Utah Network on Juveniles Offending Sexually, spoke to the bill.

MOTION:     Rep. Winn moved to pass the bill out favorably as amended.

SUBSTITUTE
MOTION:    Rep. Allen moved to move on to the next item on the agenda. The motion failed with Rep. Allen, Rep. Daniels, Rep. Moss, Rep. Seitz and Rep. Snow voting in favor of the substitute motion.

The motion to pass the bill out favorably as amended passed with Rep. Daniels and Rep. Snow voting in opposition.

H.B. 286    Waste Tax and Fee Amendments (D. Ure)

Rep. Ure introduced the bill and explained it to the committee.
