Vice Chair Winn called the meeting to order at 9:05 a.m.

MOTION:    Representative Clark moved to approve the minutes of the January 23, 2003 committee meeting. The motion passed unanimously with Representative McCartney, Representative Morgan, and Representative Murray absent for the vote.


H.B. 59    Off-highway Vehicle Program Funding (B. Goodfellow)

Vice Chair Winn reminded the committee that this bill had been discussed in the meeting of January 23, 2003. Representative Goodfellow explained the bill with the assistance of Steve Roberts, Department of Natural Resources - State Parks and Recreation.

Arie Van DeGraff, Research Analyst - Utah Association of Counties; Lincoln Shurtz, Utah League of Cities and Towns; and Suzanne Rees, Box Elder County Commission, who distributed a handout, spoke in opposition to the bill.
    
Wayne Jones, Executive Director - Utah Power Sports Dealers Association, spoke in support of the bill.



MOTION:    Representative Bird moved to amend the bill as follows:

1.    Page 1, Line 5:    Delete " eliminating the $850,000" and insert "increasing the"

2.    Page 1, Line 6:    After " Account" insert " from $850,000 to $1,050,000"

3.    Page 3, Line 62:    Reinstate "an amount equal to the lesser of the following: (i)"

4.    Page 3, Line 63:    Reinstate "; or (ii)" and insert "$1,050,000"

    The motion passed unanimously with Representative Murray absent for the vote.

MOTION:    Representative Dougall moved to pass the bill out favorably as amended. The motion passed unanimously with Representative Murray absent for the vote.

H.B. 196    Bicycle Facility Standards (C. Bennion)

Representative Bennion explained the bill to the committee.

Carlos Braceras, Deputy Director - Utah Department of Transportation, spoke in support of the bill.

Lincoln Shurtz, Utah Leagues of Cities and Towns, spoke to the bill.

MOTION:    Representative Dougal moved to pass the bill out favorably.

SUBSTITUTE MOTION: Representative Morgan moved to hold the bill for further study. The motion failed with Representative Bird, Representative Bush, and Representative Morgan voting yes. Representative McCartney was absent for the vote.

The principal motion to pass the bill out favorably passed with Representative Bush and Representative Morgan voting no. Representative McCartney was absent for the vote.

H.B. 84 Child Restraint Safety Devices, sponsored by Representative Moss, was not considered in today's meeting.

MOTION:    Representative Dougall moved to adjourn the meeting. The motion passed unanimously with Representative McCartney absent for the vote.

Vice Chair Winn adjourned the meeting at 10:04 a.m.
