Chair Murray called the meeting to order at 8:05 a.m.

MOTION:    Representative Kiser moved to approve the minutes of the February 21, 2003 committee meeting. The motion passed unanimously with Representative Alexander, Representative Clark, and Representative Winn absent for the vote.


H.B. 136    County Option Sales and Use Tax for Highways, Fixed Guideways, or Systems for Public Transit (J. Alexander)

Representative Alexander explained the bill to the committee.

MOTION:    Representative Dougall moved to pass the bill out favorably. The motion passed unanimously with Representative Clark, Representative Lockhart, Representative McCartney, Representative Morgan, and Representative Winn absent for the vote.




H.B. 346    Outdoor Advertising Amendments (B. Goodfellow)

Representative Goodfellow presented the bill to the committee with proposed amendments.

MOTION:    Representative Dougall moved to amend the bill as follows:

1.    Page 4, Line 108:    Delete "an arena or convention facility" and insert "a convention facility as defined under Section 59-12-602 and"

2.    Page 7, Lines 192-193:    Delete "activities, products, or services occurring or provided at the facility" and insert "products or services offered on the property and activities conducted on the property"

3.    Page 7, Line 196:    Delete "activities, products, or services sold at the facility" and insert "products or services sold at the facility and activities conducted on the property"

    The motion passed unanimously with Representative Alexander, Representative Clark, Representative Lockhart, Representative McCartney, Representative Morgan, and Representative Winn absent for the vote.

Representative Goodfellow explained the bill to the committee.

Kirk Brimley, Director - Utah Highway Advertising Association and Utah Sign Association, spoke in support of the bill.

MOTION:    Representative King moved to pass the bill out favorably as amended. The motion passed unanimously with Representative Alexander, Representative Clark, Representative McCartney, and Representative Winn absent for the vote.

MOTION:    Representative Dougall moved to place the bill on the Consent Calendar. The motion passed unanimously with Representative Alexander, Representative Clark, Representative McCartney, and Representative Winn absent for the vote.


H.B. 143    High Level Nuclear Shipment Safety Provisions (K. Morgan)

Representative Morgan explained the bill to the committee and distributed handouts.

Linda Hull, Director - Legislative and Government Affairs, Department of Transportation, answered questions of committee members.

MOTION:    Representative McCartney moved to pass the bill out favorably. The motion passed unanimously with Representative Alexander, Representative Clark, and Representative Winn absent for the vote.



H.B. 328    Recovery of Administrative Fee for Damages Sustained to a Rental Motor Vehicle
    
(R. Lockhart)

Representative Lockhart presented the bill to the committee with a proposed substitute to the bill.

MOTION:    Representative Lockhart moved that 1st Substitute H.B. 328 replace H.B. 328. The motion passed unanimously with Representative Alexander, Representative Clark, and Representative Winn absent for the vote.

Representative Lockhart explained the substitute bill to the committee.

MOTION:
    Representative Bush moved to amend the bill as follows:

1.    Page 1, Line 9:    Delete " an" and insert " a reasonable"

2.    Page 2, Line 37:    Delete "an" and insert "a reasonable"

    The motion passed unanimously with Representative Alexander absent for the vote.

Chris Purcell, State Farm Insurance Company; Ross Marchant, Farmers Insurance Group; and Gary R. Thorup, National Association of Independent Insurers, spoke in opposition to the bill.

Steve Jones, Car Rental Association, spoke in support of the bill.

MOTION:    Representative McCartney moved that the committee move on to the next agenda item. The motion passed with Representative King and Representative Lockhart voting no. Representative Alexander and Representative Bush were absent for the vote.

H.R. 8    Motor Carrier and Tour Bus Safety Resolution (L. Shurtliff)

Representative Shurtliff explained the resolution to the committee.

MOTION:    Representative Dougall moved to pass the resolution out favorably. The motion passed unanimously with Representative Alexander, Representative Bush, and Representative Lockhart absent for the vote.

MOTION:    Representative McCartney moved to adjourn the meeting. The motion passed unanimously with Representative Alexander, Representative Bush, and Representative Lockhart absent for the vote.

Chair Murray adjourned the meeting at 9:03 p.m.
