Committee Chair Hellewell called the meeting to order at 8:07 a.m.

     MOTION: Sen. Walker moved to approve the minutes of January 23, 2003.

    The motion passed unanimously.
        
1.     S.B. 104 Disclosure Vehicle Information for Product Recall (D. Eastman)

    Sen. Eastman explained the bill.

     MOTION: Sen. Walker moved to pass the bill out favorably.

    The motion passed unanimously with Sen. Mayne absent for the vote.

2.     S.B. 47 Labor Commission - Appeals Board (J. Valentine)

    Sen. Valentine explained the bill.

    Larry Bunkall, Government Relations Director, Parsons Behle & Latimer, former member, Board of Appeals, expressed concerns with the bill.

    Lee Ellertson, Commissioner, Labor Commission, spoke concerning amending the bill.


    The following amendments were proposed:

    1. Page 3, Line 62:    After "assign an individual" insert "who meets the qualifications of Section 34A-1-205"

    2. Page 3, Line 67:    After "individual" insert "who meets the qualifications of Section 34A-1-205"
         
     MOTION:  Sen. Eastman moved to adopt the amendments.

    The motion passed unanimously

     MOTION: Sen. Walker moved to pass the bill out favorably as amended.

    The motion passed unanimously.

3.     S.B. 10 Preneed Funeral Arrangement Amendments (P. Arent)

    
Sen. Arent explained the bill.

    Craig Jackson, Director, DOPL; Francine Giani, Director, Consumer Protection and Tom Jensen, Executive Council, AARP, spoke in support of the bill.        

    Shaun Myers, President, Utah Funeral Directors Association, spoke in opposition to the bill.
    
     MOTION: Sen. Mayne moved to pass the bill out favorably.

    The motion passed unanimously with Sen. Bramble absent for the vote.

4.     S.B. 91 Funeral Services Amendments (D. Gladwell)

    Sen. Gladwell presented the bill and 1st Sub. S.B. 91 was distributed.

     MOTION: Sen Walker moved to adopt 1st Sub. S.B. 91.

    The motion passed unanimously with Sen. Bramble absent for the vote.

    Sen. Gladwell explained the bill assisted by Shaun Meyers, Pres., Utah Funeral Directors Association.


    Tom Jensen, AARP, spoke to the bill.

     MOTION: Sen. Walker moved to adjourn.

    The motion failed with Sens. Walker and Mayne voting in favor of the motion and Sens. Bramble, Eastman, Hatch and Hellewell voting in opposition.

    Joyce Mitchell, President, Funeral Consumers Alliance of Utah, spoke to the bill.
    W. Ray Walker, DOPL, answered questions from the committee.

     MOTION: Sen. Bramble moved to adjourn.

    The motion passed unanimously.

    Chair Hellewell adjourned the meeting at 9:20 a.m.
