         Committee Chair Hellewell called the meeting to order at 3:40 p.m.

Chair Hellewell announced that 1st Sub. H.B. 12 will not be discussed today.

     MOTION: Sen. Eastman moved to adopt the minutes of January 30, 2003.

    The motion passed unanimously, with Sens. Hatch, Davis and Mayne absent for the vote.

1.     1st Sub. H.B.78 Lien Recovery Fund - Rate of Interest (G. Snow)

    Rep. Snow explained the bill and distributed a chart, “Summary of Attorney Fees Data” and a graph, “Residential Lien Recovery Fund.”

    John Young, Utah Construction Industry, spoke in opposition to the bill.

    Clair Yaussi spoke in opposition to the bill.

    Bob Burton, Burton Lumber and Hardware, spoke in opposition to the bill.

    Taz Biesinger, Utah Homebuilders Association, spoke in favor of the bill.

    Joseph Rust, Homeowners, Suppliers and Subcontractors, spoke in opposition to the bill.

    Earl Webster, Coordinator, Lien Recovery Fund, spoke to the bill.


     MOTION: Sen. Eastman moved to go to the next item on the agenda.

    The motion passed unanimously, with Sen. Hatch absent for the vote.

2.     S.B. 114 Journal of Notary Public Acts (P. Knudson)

    
Sen. Knudson explained the bill.

    Sen. Bramble declared a conflict of interest.

    Sen. Hatch declared a conflict of interest.

    Kathy Berg, Division Director, Corporations and UCC, spoke in favor of the bill.

     MOTION: Sen. Bramble moved to go to the next item on the agenda.

    The motion passed unanimously.

3.     S.B. 120 Payment of Wages Amendments (S. Jenkins)

    
Sen. Jenkins explained the bill.

    Joe Gallegos, Director, Anti-discrimination Division, Labor Commission, spoke in favor of the bill.

     MOTION: Sen. Mayne moved to pass the bill out favorably.

    The motion passed unanimously.

4.     S.B. 130 Regulations of Check Cashers (E. Mayne)

    
Sen. Mayne explained the bill.

    Ed Leary, Commissioner, Financial Institutions spoke in favor of the bill.

     MOTION: Sen. Mayne proposed the following amendments:

    1.    Page 4, Line 97:    After "on the principal" delete "owned" and insert "owed"

    2.    Page 4, Line 98:    After "at any time" insert "prior to maturity"



    3.     Page 4, Line 104:    After "collect" insert "additional"

    4.    Page 4, Line 111:    After "Notwithstanding" delete "Subsection (4)(c)" and insert "Subsections (4)(a) and (4)(c)"

    5.    Page 4, Line 112:    After "may use the" insert "remedies and"

     MOTION: Sen. Mayne moved to adopt the amendment.

    The motion passed unanimously.

    Kip Cashmore, Vice President, UCLA, spoke in favor of the bill.

    Linda Hiton, Director, CORC, spoke in favor of the bill.

     MOTION: Sen. Bramble moved to pass the bill as amended out favorably.

    The motion passed unanimously.

5.     H.B. 38 Division of Corporations Amendment (J. Gowans)

    
Rep. Gowans explained the bill.

     MOTION: Sen. Davis moved to pass the bill out favorably.

    The motion passed unanimously.

     MOTION: Sen. Waddoups moved to adjourn.

    The motion passed unanimously.

    Chair Hellewell adjourned the meeting at 5:00 p.m.
