Committee Chair Hellewell called the meeting to order at 8:10 a.m.

     MOTION: Sen. Walker moved to approve the minutes of February 20, 2003.

    The motion passed unanimously with Sens. Hatch, Davis and Mayne absent for the vote.
        
1.     2nd Sub. S.B. Regulation of Coercive Restraint Practices (P. Hellewell)

    
MOTION: Sen. Hellewell moved to return the bill to Rules.

    The motion passed unanimously with Sens. Hatch, Davis and Mayne absent for the vote.

2.     S.B. 203 Condominium Law Amendments (M. Waddoups)

    
Sen. Waddoups explained the bill.

    John D. Richards, Attorney, Vial Fotheringham; Patricia Worthington, Deerfield Homeowners Association; Lincoln Hobbs, Attorney; Michael Johnson, President, CEO, FCS Property Management; and Chris Kyler, General Counsel, Utah Association of Realtors; spoke in support of the bill.

    Taz Beisinger, CEO, Utah Homebuilders Association, spoke in opposition to the bill.



    Sen. Hatch declared a conflict of interest.
    
     MOTION: Sen. Waddoups moved to pass the bill out favorably.

    The motion passed with Sen. Davis voting in opposition.

3.     S.B. 206 Vehicle Sale and Security Interest Amendments (D. Steele)

    
Sen. Steele explained the bill and the following amendments were distributed:

    1. Page 1, Line 22:    After "affect" insert ": (a)"

    2. Page 1, Line 23:    After "chapter" insert
        "; or
        (b) the calculation of sales and use tax payable under Title 59, Chapter 12, Sales and Use Tax Act
"

     MOTION: Sen. Bramble moved to adopt the amendments.

    The motion passed unanimously with Sens. Eastman, Hatch, Davis and Mayne absent for the vote.

     MOTION: Sen. Walker moved to pass the bill out favorably.

    The motion passes unanimously with Sens. Hatch, Davis and Mayne absent for the vote.

4.     S.B. 177 Regulation of Debt Cancellation Agreements and Debt Suspension Agreements (J. Valentine)

    
Sen. Valentine explained the bill and the following amendments were distributed:

    1. Page 1, Line 21:    After "corporations;" delete "or"

    2. Page 1, Line 22:    After "associations" delete "." and insert "; or"

    3. Page 1, Line 22:    After line 22, insert:
        "(v) wholly owned subsidiaries of a depository institution listed in this Subsection (1)(a)."


    4. Page 3, Line 80:    After line 80, insert:
        "(e) "Subsidiary" is as defined in Section 7-1-103."

    5. Page 4, Line 103:    After "by an institution" insert "or a subsidiary of an institution"

    6. Page 4, Line 105:    After "(b)" delete "is" and after "jurisdiction of the" delete "institution's"

    7. Page 4, Line 105:    After "primary regulator" delete "." and insert "of:
        (i) the institution; or
        (ii) the subsidiary of an institution.
"

     MOTION: Sen. Bramble moved to adopt the amendments.

    The motion passed with Sen. Davis absent for the vote.

     MOTION: Sen. Bramble moved to pass the bill out favorably as amended.

    The motion passed unanimously with Sen. Davis absent for the vote.

    MOTION: Sen. Walker moved to adjourn.

    The motion passed unanimously with Sen. Davis absent for the vote.
