Committee Chair Wright called the meeting to order at 3:40 p.m.

    MOTION: Sen. Steele moved to approve the minutes of January 30, 2003. The motion passed unanimously, with Sen. Gladwell and Sen. Valentine absent for the vote.

1.     S.B. 32 Driver Education Courses (C. Walker)

    Sen. Carlene Walker discussed the bill.

     MOTION: Sen. Wright moved to amend the bill as follows:

    1.    Page 1, Line 12:    Delete " allows a school district to provide" and insert " requires a school district that provides driver education to offer"

    2.    Page 1, Line 13:    Delete " allows" insert " requires"

    3.    Page 2, Line 48:    After "school district may" insert "consistent with Section 53A-3-410,"




    4.    Page 4, Line 98:    Delete line 98 and insert
                    "(1) A school district that provides driver education shall:"

    5.    Page 4, Line 101:    Delete "or"

    6.    Page 4, Line 102:    After line 102 insert
                    "or
                    (iii) other programs not involving direct classroom instruction during the regular school day, approved by the district; and
"

    7.    Page 4, Lines 104:    Delete ";" and insert "."

    8.    Page 4, Line 105    Delete "(c)" and insert
                    "(2) A school district that provides driver education may:

    12.    Page 4, Line 114:    Delete "(2)" and insert "(3)"

    The motion passed unanimously with Sen. Valentine absent for the vote.

     MOTION: Sen. Hale moved to pass the bill out favorably, as amended. The motion passed unanimously with Sen. Valentine absent for the vote.

2.     S.B. 57 Charter School Amendments (H. Stephenson)

    Sen. Stephenson, assisted by Connie Steffen, explained the changes the bill makes to the Charter School Act.

     MOTION: Sen. Stephenson moved to amend the bill as follows:

    1.    Page 4, Line 113:    After "address" insert ", if known at the time the charter is signed"

     SUBSTITUTE MOTION: Sen. Valentine moved to amend the bill as follows:




            1.    Page 4, Line 112:    Delete "physical facility" and insert "district" and after "school"                                                                      delete "will" and insert " is intended to"

    2.    Page 4, Line 113:    Delete "its" and insert "physical facility's" and after "address" insert                 ", if known at the time the charter is signed"

    The motion passed unanimously.

    Supt. Steven Laing, State Superintendent of Public Instruction, and Ms. Patricia Bradley, Utah State Office of Education, answered questions about the bill.

    Ms. Sarah Meier, Utah School Boards Association, stated that the Utah School Boards Association takes no position on the bill.

     MOTION: Sen. Stephenson moved to amend the bill as follows:

    1.    Page 1, Line 5:    Delete "expanding" and insert "removing a limitation on"

    2.    Page 2, Line 30:    Bracket "(i)" and delete "effective July 1, 2003, 20" and after "schools" bracket the semi-colon

    3.    Page 2, Line 31:    Delete line 31

    4.    Page 2, Line 32:    Delete "(iii)" and insert "including"

    Ms. Pat Rusk, Utah Education Association, spoke in opposition to the amendment.

    The motion passed unanimously.    

     MOTION: Sen. Valentine moved to reconsider the committee's previous motion to amend.

    The motion passed unanimously.

     MOTION: Sen. Valentine moved to reinstate the original language and amend the bill as follows:

    1.    Page 2, Line 30:    After "2003," delete "20" and insert "24"

    2.    Page 2, Line 31:    After "additional" delete "four" and insert "eight"




    The motion passed unanimously.

     MOTION: Sen. Stephenson moved to pass the bill out favorably, as amended. The motion passed unanimously.

3.     H.B. 39S1 Repeal of Education Reports and Duties (M. Dayton)

    Rep. Margaret Dayton said the bill eliminates certain reports made by the State Board of Education. Supt. Steven Laing, Utah State Office of Education, assisted in the presentation.

     MOTION: Sen. Valentine moved to pass the bill out favorably. The motion passed unanimously with Sen. Steele absent for the vote.

     MOTION: Sen. Hale moved to adjourn. The motion passed unanimously with Sen. Steele absent for the vote.

    Committee Chair Wright adjourned the meeting at 5:01 p.m.
