Committee Chair Wright called the meeting to order at 4:34 p.m.

     MOTION: Sen. Arent moved to approve the minutes of February 19, 2003. The motion passed unanimously, with Sen. Buttars, Sen. Gladwell, Sen. Steele and Sen. Valentine absent for the vote.

1.     S.B. 168 Higher Education Legislative Task Force (D. Gladwell)

     MOTION: Sen. Stephenson moved to send S.B. 168 back to the Rules Committee. The motion passed unanimously with Sen. Buttars, Sen. Gladwell, Sen. Steele and Sen. Valentine absent for the vote.

2.     H.B. 223 Changing State Song (D. Love)

    Rep. Dana Love presented the bill, which would change the state song from "Utah We Love

Thee" to "Utah...This is The Place. Children from Cook Elementary School sang for the committee.

    Ms. Trudy Henderson, Cook Elementary School, spoke in support of the bill.

     MOTION: Sen. Hale moved to pass the bill out favorably. The motion passed unanimously with Sen. Buttars and Sen. Stephenson absent for the vote.

3.     H.B. 76 Truancy Amendments (D. Bourdeaux)

    Rep. Duane Bourdeaux introduced the bill.

    MOTION: Sen. Hale moved to amend the bill as follows:

    1.    Page 2, Line 29
        House Floor
        Amendments
        1-28-2003:            After "(f)" insert "(i)"

    2.    Page 2, Line 30
        House Floor
        Amendments
        1-28-2003:            After line 30, insert: "(ii) "Truant minor" does not include a minor who is homeschooled under the provisions of Subsection 53A-11-102(1)(b)(ii)."

    The motion passed unanimously with Sen. Buttars absent for the vote.

    The following spoke in support of the bill:

     MOTION: Sen. Valentine moved to amend the bill as follows:

        1-28-2003:            After "refuse to" reinstate "respond" and after "respond" delete "cooperate with" and insert "to"




    2.    Page 2, Line 38
        House Floor
        Amendments
        1-28-2003:            After "section," delete "cooperate with school authorities" and insert "respond to a written request"

    The motion passed unanimously with Sen. Buttars and Sen. Stephenson absent for the vote.

     MOTION: Sen. Valentine moved to pass S.B. 223, as amended, out favorably. The motion passed with Sen. Wright voting in opposition and Sen. Buttars and Sen. Stephenson absent for the vote.

    Sen. Gladwell assumed the chair.

4.     H.B. 161S3 Snow College Richfield Campus (B. Johnson)

    Rep. Brad Johnson introduced the bill. Dr. Gregory Fitch, President, Utah College of Applied Technology, assisted in the presentation.

    The following spoke in support of the bill:
    Mr. Rick Wheeler, Vice President, Snow College
    Dr. Cecelia Foxley, Commissioner of Higher Education
    Ms. Mary Shumway, Utah State Office of Education

     MOTION: Sen. Arent moved to pass the bill out favorably. The motion passed unanimously with Sen. Wright and Sen. Stephenson absent for the vote.

5.     H.C.R. 4 Resolution Urging Federal and State Action Against Internet Abuses
    (D. Love)

    Rep. Dana Love introduced the bill.

     MOTION: Sen. Arent moved to pass the bill out favorably. The motion passed unanimously with Sen. Wright absent for the vote.

     MOTION: Sen. Arent moved to place the bill on the consent calendar. The motion passed unanimously with Sen. Wright absent for the vote.




     MOTION: Sen. Valentine moved to adjourn. The motion passed unanimously with Sen. Wright absent for the vote.

    Committee Chair Gladwell adjourned the meeting at 5:37 p.m.
