Chair Walker called the meeting to order at 8:10 a.m.
MOTION: Sen. Arent moved to approve the minutes of January 29, 2003.
The motion passed unanimously with Sen. Hale absent for the vote.
1. S. B. 87 Library Amendments (M. Waddoups)
Sen. Waddoups distributed 1st Sub. S. B. 87 Library Amendments and explained the bill, assisted by Brent Gardner, Utah Association of Counties.
MOTION: Sen. Arent moved to adopt 1st Sub S. B. 87.
The motion passed unanimously with Sen. Hale absent for the vote.
Sen. Waddoups proposed the following amendments:
1. Page 2, Line 28: After "ordinance" delete "," and insert "."
2. Page 2, Lines 29-30: Delete lines 29-30.
MOTION: Sen. Arent moved to adopt the amendments.
The motion passed unanimously with Sen. Hale absent for the vote.
Dan McConkie, Davis County Commissioner; David Wilson, Weber County Deputy Attorney; Camille Cain and Glen Burton, Weber County Commissioners, spoke for the bill. Laura Miller, Chairman of the Salt Lake County Library Board, spoke for the bill with reservations.
Pete Giacoma, Director, Davis County Library, spoke to the bill. Kayla Willey, President, Utah Library Association; Chip Ward, Legislative Commission Co-Chairman, Utah Library Association; Linda Waangsgard, Director, Weber County Library Board, and Evelyn

MOTION:
Sen. Hale moved to hold the bill.
SUBSTITUTE MOTION: Sen. Hickman moved to hold the bill and reschedule for the
February 6, 2003, committee meeting.
The motion passed unanimously with Sen. Walker absent for the vote.

S.B. 29 Legislative Access to Certain Information (M. Dmitrich)
Sen. Dmitrich
explained the bill, assisted by Wayne Welsh, Legislative Auditor General, and
distributed the following amendments.
1. Page 1, Line 7: After " Auditor General." insert " This act provides an immediate
effective date."
2. Page 8, Line 231: After line 231 insert:
"Section 3. Effective date.
If approved by two-thirds of all the members elected to each house,
this act takes effect upon approval by the governor, or the day
following the constitutional time limit of Utah Constitution Article
VII, Section 8, without the governor's signature, or in the case of a
veto, the date of veto override.
"

Sen Walker resumed the chair and distributed the following amendments:

Colin Winchester, Executive Director, Judicial Conduct Commission, spoke for the bill.
M. Gay Taylor, General Counsel, Office of Legislative Research and General Counsel, spoke to
the bill and requested permission to amend the long title as suggested by Senator Arent:
Page 1, Line 6: After "Taxation Code" delete " and Judicial Code to allow for audit by the Office of the Legislative Auditor General" and
Insert " to allow for audit by the Office of Legislative Auditor General and the
State Auditor's Office and amends the Judicial Code to allow for audit by the Office of Legislative Auditor General"
MOTION: Sen. Walker moved to adopt the printed amendments and proposed long title change.
The motion passed unanimously with Sen. Eastman absent for the vote.
MOTION: Sen. Hickman moved to pass S. B. 29, as amended, with a favorable recommendation.
The motion passed unanimously with Sen. Eastman absent for the vote.

Rep. Noel explained the bill.
MOTION: Sen. Hickman moved to pass the bill with a favorable recommendation.
The motion passed unanimously with Sen. Eastman absent for the vote.
4. H. B. 168 Filling Midterm Vacancies in the Legislature (R. Becker)
Rep. Becker explained the bill.
Gary Doxey, Legal Counsel, Governor's Office, spoke against the bill.
MOTION: Sen. Hickman moved to pass the bill with a favorable recommendation.
The motion passed unanimously.
5. S.B. 112 Government Records Protections for Federal Mission of National Guard
