    Chair Walker called the meeting to order at 8:10 a.m.

     MOTION: Sen. Arent moved to approve the minutes of February 6, 2003.

    The motion passed unanimously with Sens. Evans, Hale, and Knudson absent for the vote.

1.     S. B. 129 State and Local Agencies Criteria in Awarding Bids (J. Evans)

    Sen. Evans explained the bill and distributed the following amendments:

    1.    Page 1, Line 7:    After " agencies to require" insert " certain"

    2.    Page 1, Line 10:    After " contracts, to" insert " certain"

    3.    Page 2, Line 45:    After "(4)(a)" delete "The" and insert "Subject to

                     Subsection (4)(c), the
"

    4.    Page 2, Line 47:     Delete "$100,000" and insert "$1,000,000"

    5.    Page 2, Line 54:    Delete "$100,000" and insert "$1,000,000" and after "subdivision may" delete "give" and insert "take into consideration the fact that"

    6.    Page 2, Line 55:    At the beginning of line 55 delete "preference to" and after

                     "carrier" delete "that"





    7. Page 3, Line 59:    After line 59 insert:

                "(c) This Subsection (4) applies only if the contractor,                  subcontractor, material supplier, or carrier from which a proposal                                                                                             
                is requested employs 15 or more persons."

8. Page 3, Line 63:    Delete "$100,000" and insert "$1,000,000"
    
    MOTION:
Sen. Arent moved to adopt the amendments.

    The motion passed unanimously with Sens. Evans, Hale, and Knudson absent for the vote.

    MOTION: Sen. Arent moved to pass the bill, as amended, with a favorable recommendation.

    The motion passed with Sens. Walker, Arent, and Hale voting in favor; Sens. Eastman and Hickman voting against; and Sens. Evans and Knudson absent for the vote.

2.     S. B. 68 Voter Identification Requirements (D. Eastman)

    Sen. Eastman explained the bill.

     MOTION: Sen. Hickman moved to pass the bill with a favorable recommendation.

     The motion passed unanimously with Sen. Knudson absent for the vote.     
3.     S. B. 56 Waiver of Governmental Immunity by Governmental Entities (J. Evans)

    Sen. Evans distributed 1st Sub. 56, and explained the bill, assisted by Bob Reese, Associate General Counsel.

    Dan McConkie, Davis County Commissioner, spoke to the bill.

     MOTION: Sen. Hickman moved to send the original bill, S. B. 56, back to Rules.

     The motion passed unanimously with Sen. Knudson absent for the vote.

4.     H.J.R. 10 Resolution Encouraging Sharing Exhibits with History Museum

    (D. Clark)


    Rep. Clark explained the bill.
    
     MOTION: Sen. Arent moved to pass the bill with a favorable recommendation.

     The motion passed unanimously with Sen. Knudson absent for the vote.

    Sen. Arent moved to place the bill on the Consent Calendar.

    The motion failed with Sens. Walker, Arent, Eastman, Evans, Hale, and Hickman voting in

     favor; Sen. Evans voting against; and Sen. Knudson absent for the vote.

5.     S. B. 87 1st Sub. Library Amendments (Sen. Waddoups)

    Sen. Waddoups explained the bill and distributed the following amendment:

    1. Page 2, Line 28:    After "ordinance" delete "." and insert ", including, but not limited

         to, establishing policies for collections and information resources

         that are consistent with state and federal law.
"

     MOTION: Sen. Arent moved to adopt the amendment.

     The motion passed unanimously with Sen. Knudson absent for the vote.

    Brent Gardner, Utah Association of Counties; Mayor Nancy Workman, Salt Lake County; Shauna Kerr, Summit County Commission; Camille Cain, Weber County Commission; and Steve White, Utah County Commission, spoke for the bill.

    Margaret Rostkowski, Weber County Library Board, and Britton Lund, Co-Chair, Utah Library Association Legislative Committee, spoke against the bill.

    MOTION: Sen. Knudson moved to moved to pass the bill with a favorable
    recommendation.

     The motion passed unanimously with Sen. Evans declaring a conflict of interest.

6.     S. B. 62 Utah Home Inspection Standard of Practice (P. Julander)

     At request of the sponsor, the bill was not considered.


    
     MOTION: Sen. Hickman moved to adjourn.

     The motion passed unanimously.
