Committee Chair Bell called the meeting to order at 4:35 p.m.
MOTION: Sen. Arent moved to approve the minutes of February 19 and February 21, 2003.
The motion passed unanimously with Sen. Evans and Sen. Gladwell absent for the vote.
1. S.B. 223 Revisions to Parent Time (L. Hillyard)
Sen. Hillyard introduced the bill. Lori Nelson, Family Law Section, Utah State Bar, assisted in the presentation.
Steve Barrows, citizen; Kim Grant, For Children's Sake!; Micky Grant, Marriage and Family Therapist, For Children's Sake!; and Connie Barnes, For Children's Sake!, spoke to the bill.
Todd Brown, non-custodial father; Jacqueline DeGaston, family law attorney; and Conrad Lloyd, non-custodial father, spoke in opposition to the bill
Rick Schwermer, Assistant State Court Administrator; and Brian Lamano, citizen, spoke in support of the bill.
MOTION: Sen. Hillyard moved to pass S.B. 223 out with a favorable recommendation.
The motion passed with Sen. Gladwell voting in opposition.
2. S.B. 186 Uninsured and Underinsured Motorist Coverage (D. Eastman)
Sen. Dan Eastman introduced the bill. Steve Sullivan, Utah Trial Lawyers Association, assisted in the presentation.
MOTION: Sen. Arent moved to amend S.B. 186 as follows:
1. Page 6, Line 161: Bracket "relative" and insert "dependent"
2. Page 6, Line 164: After "covered person" insert ", the covered person's parents," and delete "resident relative" and insert "parent's dependent"
3. Page 8, Line 238: After "
4. Page 8, Lines 242-244: After "[
5. Page 9, Line 246: After line 246 insert "(iii) Subsection (10)(a)(ii) applies to all persons except a covered person as defined under Subsections (10)(b)(i) and (ii)."
6. Page 9, Line 252: After "households" insert "and who is injured while occupying or using a motor vehicle that is not owned, leased, or furnished to the covered person, the covered person's parents, or the covered person's parent's dependent"
The motion passed with Sen. Hillyard absent for the vote.
Chris Purcell, State Farm Insurance Company, spoke in support of the bill.
MOTION: Sen. Arent moved to pass S.B.186, as amended, out with a favorable recommendation.
The motion passed unanimously with Sen. Evans and Sen. Hillyard absent for the vote.
3. H.B. 88S1 Payment of Reward upon Arrest and Conviction (D. Love)
Rep. Dana Love introduced the bill.
MOTION: Sen. Gladwell moved to pass H.B. 88S1 out with a favorable recommendation.
The motion passed unanimously with Sen. Hillyard absent for the vote.
4. H.B. 119 Judicial Conduct Commission Revisions (K. Bryson)
Rep. Katherine Bryson introduced the bill.
The Honorable Christine Durham, Chief Justice, Utah Supreme Court; The Honorable Darwin Hansen, Second District Court Judge; and Rick Schwermer, Assistant State Court Administrator, spoke in opposition to the bill.
Rep. David Ure spoke in support of the bill.
MOTION: Sen. Gladwell moved to pass H.B. 119 out with a favorable recommendation.
The motion passed with Sen. Arent and Sen. Hillyard voting in opposition and Sen. Buttars absent for the vote.
MOTION: Sen. Evans moved to adjourn.
