Meeting was called to order by Chair Evans at 3:40 p.m.
1. S.B. 37 Task Force Study of Impact of Gravel Pits (P. Knudson)
Sen. Peter Knudson presented the bill. Rich Thorn, President, Associated General Contractor of Utah and Greg Fredde, President, Utah Mining Association, spoke to the bill.
MOTION: Sen. Wright moved to adopt the following amendments to S.B. 37:
1. Page 1, Line 17: Delete "12" and insert "13"
2. Page 1, Line 24: After "Towns;" delete "and"
3. Page 1, Line 26: After "Quality" insert "; and
(g) the director of the Division of Oil, Gas and Mining created under Section 40-6-15, or the director's designee"
The motion passed unanimously.
MOTION: Sen. Davis moved to pass S.B. 37 Task Force Study of Impact of Gravel Pits (P. Knudson) out favorably as amended.
The motion passed unanimously.
2. S.B. 84 Real Property Voluntary Environmental Restrictive Covenants (B. Wright)
Sen. Wright present the bill and proposed amendments.
MOTION: Sen. Wright moved to adopt the following amendments to S.B. 84:
1. Page 2, Line 50: After "recorded by" insert "the owner of the real property in"
The motion passed unanimously.
MOTION: Sen. Hellewell moved to pass S.B. 84 Real Property Voluntary Environmental Restrictive Covenants (B. Wright) out favorably as amended.
The motion passed unanimously.
3. S.B. 85 Underground Storage Tank Amendment (B. Wright)
Sen. Wright presented the bill and proposed amendments:
MOTION: Sen. Wright moved to adopt the following amendments to S.B. 85:
1. Page 1, Line 8: After " year." insert " The act has a July 1, 2003, effective date."
2. Page 3, Line 63: After line 63 insert
" Section 2. Effective Date."
"This act takes effect on July 1, 2003."
The motion passed unanimously.
John Hill, Utah Petrol Petroleum Marketers and Retailers Association, and Alan Edwards. Risk Manager, State of Utah, spoke in support of the bill.
MOTION: Sen. Davis moved to move S.B. 85 Underground Storage Tank Amendment (B. Wright) out favorably as amended:
The motion passed unanimously.
4. S.C.R. 1 Resolution Urging Light Pollution Prevention (R. Allen)
Sen. Ron Allen present the resolution.
Dr. John Sohl, Professor of Physic, Weber State University; Anthony Arrigo, Co-Founder of Utah Skies; Stacy Palen, Assistant Professor Weber State University; and Don Brown, Co-Founder Utah Skies spoken in support of the resolution. Tom Bingham, President, Utah Manufacturers Association; Jeff Young, Division Manager, Young Electric Sign Company; Nyle Fox, Outdoor Advertising Association and Kirk Brimley, Utah Highway Sign Association spoke in opposition.
Senator Evans turned the chair to Sen. Hellewell.
MOTION: Sen. Davis moved to pass S.C.R. 1 Resolution Urging Light Pollution Prevention (R. Allen) out favorably.
The motion failed with Sen. Davis and Sen. Julander voting in favor; Sen. Hellewell, Sen. Jenkins, and Sen. Wright voting in opposition with Sen. Evans absent during the time of the vote.
5. H.B. 182 Air Conservation Act Amendments (M. Morley)
Rep. Mike Morley presented the bill. No action was taken due to the lack of a quorum.
