             9      General Description:
             10          This bill modifies the State System of Higher Education Code by creating a tuition
             11      waiver.
             12      Highlighted Provisions:
             13          This bill:
             14          .    requires state institutions of higher education to waive the tuition of a Utah resident
             15      admitted to h [ a ] AN UNDERGRADUATE h program of study leading to a degree or certificate, if the
             15a      student has
             16      received a Purple Heart award as a result of military service.
             17      Monies Appropriated in this Bill:

             20          This bill takes effect on July 1, 2004.

             27      Be it enacted by the Legislature of the state of Utah:


             28          Section 1. Section 53B-8e-101 is enacted to read:
             29     
CHAPTER 8e. UTAH PURPLE HEART RECIPIENTS' TUITION ACT

             30          53B-8e-101. Title.
             31          This chapter is known as the "Utah Purple Heart Recipients' Tuition Act."
             32          Section 2. Section 53B-8e-102 is enacted to read:
             33          53B-8e-102. Definitions.
             34          As used in this chapter:
             35          (1) "Purple Heart recipient" means any Utah resident who is a military veteran and who
             36      has earned a Purple Heart award as a result of military service.
             37          (2) "State institution of higher education" means an institution listed in Section
             38      53B-1-102 .
             39          (3) (a) "Tuition" means tuition at the rate for residents of the state.
             40          (b) "Tuition" excludes fees.
             41          Section 3. Section 53B-8e-103 is enacted to read:
             42          53B-8e-103. Tuition waivers for Purple Heart recipients -- Qualifications --
             43      Limitations.
             44          (1) Beginning in the 2004-05 academic year, a state institution of higher education
             45      shall waive h UNDERGRADUATE h tuition for each Purple Heart recipient who:
             46          (a) is admitted as a full-time, part-time, or summer school student in h [ a ] AN
             46a      UNDERGRADUATE h program of
             47      study leading to a degree or certificate;
             48          (b) is a resident student of the state as determined under Section 53B-8-102 ; and
             49          (c) submits verification as provided in Subsection (2) that the student is a Purple Heart
             50      recipient.
             51          (2) A Purple Heart recipient seeking a tuition waiver shall request the Division of
             52      Veterans Affairs to provide the verification required by Subsection (1)(c). The Division of
             53      Veterans Affairs shall provide the verification upon obtaining evidence satisfactory to the
             54      division that the student is a Purple Heart recipient.
             55          Section 4. Effective date.
             56          This bill takes effect on July 1, 2004.
