             11      LONG TITLE
             12      General Description:
             13          This bill amends the Uniform Electronic Transactions Act regarding electronic records
             14      in government agencies.
             15      Highlighted Provisions:
             16          This bill:
             17          .    requires state agencies that offer direct assistance to the business community to
             18      participate in a one-stop state website;
             19          .    designates the state agencies that must participate; and
             20          .    describes some of the services that may be available on the website.

             29      Be it enacted by the Legislature of the state of Utah:
             30          Section 1. Section 46-4-503 is amended to read:
             31           46-4-503. Government products and services provided electronically.
             32          (1) Notwithstanding Section 46-4-501 , a state governmental agency that administers
             33      one or more of the following transactions shall allow those transactions to be conducted
             34      electronically:
             35          (a) an application for or renewal of a professional or occupational license issued under
             36      Title 58, Occupations and Professions;
             37          (b) the renewal of a drivers license;
             38          (c) an application for a hunting or fishing license;
             39          (d) the filing of:
             40          (i) a return under Title 59, Chapter 10, Individual Income Tax Act or 12, Sales and Use
             41      Tax Act;
             42          (ii) a court document, as defined by the Judicial Council; or
             43          (iii) a document under Title 70A, Uniform Commercial Code;
             44          (e) a registration for:
             45          (i) a product; or
             46          (ii) a brand;
             47          (f) a renewal of a registration of a motor vehicle;
             48          (g) a registration under:
             49          (i) Title 16, Corporations;
             50          (ii) Title 42, Names; or
             51          (iii) Title 48, [Partnerships] Partnership; or
             52          (h) submission of an application for benefits:
             53          (i) under Title 35A, Chapter 3, Employment Support Act;
             54          (ii) under Title 35A, Chapter 4, Employment Security Act; or
             55          (iii) related to accident and health insurance.
             56          (2) The state system of public education, in coordination with the Utah Education
             57      Network, shall make reasonable progress toward making the following services available
             58      electronically:
             59          (a) secure access by parents and students to student grades and progress reports;


             60          (b) e-mail communications with:
             61          (i) teachers;
             62          (ii) parent-teacher associations; and
             63          (iii) school administrators;
             64          (c) access to school calendars and schedules; and
             65          (d) teaching resources that may include:
             66          (i) teaching plans;
             67          (ii) curriculum guides; and
             68          (iii) media resources.
             69          (3) A state governmental agency shall:
             70          (a) in carrying out the requirements of this section, take reasonable steps to ensure the
             71      security and privacy of records that are private or controlled as defined by Title 63, Chapter 2,
             72      Government Records Access and Management Act;
             73          (b) in addition to those transactions listed in Subsections (1) and (2), determine any
             74      additional services that may be made available to the public through electronic means; and
             75          (c) as part of their agency information technology plans required by Section
             76      63D-1a-303 , report on the progress of compliance with Subsections (1) through (3).
             77          (4) Notwithstanding the other provisions of this part, a state governmental agency is
             78      not required by this part to conduct a transaction electronically if:
             79          (a) conducting the transaction electronically is not required by federal law; and
             80          (b) conducting the transaction electronically is:
             81          (i) impractical;
             82          (ii) unreasonable; or
             83          (iii) not permitted by laws pertaining to privacy or security.
             84          (5) (a) For purposes of this Subsection (5), "one-stop shop" means the consolidation of
             85      access to diverse services and agencies at one location including virtual colocation.
             86          (b) State agencies that provide services or offer direct assistance to the business
             87      community shall participate in the establishment, maintenance, and enhancement of an
             88      integrated Utah business web portal known as Business.utah.gov. The purpose of the business
             89      web portal is to provide "one-stop shop" assistance to businesses.
             90          (c) State agencies shall partner with other governmental and nonprofit agencies whose


             91      primary mission is to provide services or offer direct assistance to the business community in
             92      Utah in fulfilling the requirements of this section.
             93          (d) The following state agencies shall comply with the provisions of this Subsection
             94      (5):
             95          (i) Department of Community and Economic Development, which shall serve as the
             96      managing partner for the website;
             97          (ii) Department of Workforce Services;
             98          (iii) Department of Commerce;
             99          (iv) Tax Commission;
             100          (v) Department of Administrative Services - Division of H PURCHASING AND h General
             100a      Services H [ and
             101      Procurement
] h
, including other state agencies operating under a grant of authority from the
             102      division to procure goods and services in excess of $5,000;
             103          (vi) Department of Agriculture;
             104          (vii) Department of Natural Resources; and
             105          (viii) other state agencies that provide services or offer direct assistance to the business
             106      sector.
             107          (e) The business services available on the business web portal may include:
             108          (i) business life cycle information;
             109          (ii) business searches;
             110          (iii) employment needs and opportunities;
             111          (iv) motor vehicle registration;
             112          (v) permit applications and renewal;
             113          (vi) tax information;
             114          (vii) government procurement bid notifications;
             115          (viii) general business information;
             116          (ix) business directories; and
             117          (x) business news.
